A Cowes mum busted drink-driving nearly five times the legal limit claimed she had not driven when police found her sitting in the driver’s seat of her car, stuck in shrubs in Ventnor.
Mikayla Wilder, 39, pleaded guilty in the Korumburra Magistrates’ Court to charges including drink-driving, drug-driving and refusing to undergo a breath test.
The court heard Wilder drove her car past a dead end and into a reserve in Ventnor on February 7, 2020.
She continued through scrubland and crashed through a property fence, destroying it in the process.
She continued driving through shrubs where her car become stuck.
When police arrived on the scene, they found Wilder’s in the driver’s seat and asked her to undergo a breath test.
Wilder refused and said she had not driven.
Wilder attended Wonthaggi Hospital where a sample of blood was taken.
Cannabis and 0.232 grams of alcohol were found in her system.
Wilder’s lawyer Ashlee McPhail said the mum-of-five had a “longstanding history with alcohol use” and had “made several attempts to address her issues” with it.
Ms McPhail claimed that Wilder suffered from a back injury where she turned to alcohol and cannabis to self-medicate.
“At this time she was suffering from a constant and debilitating back pain,” Ms McPhail said.
“She was in chronic pain, caring for her children and she didn’t have the support from her family who live in Melbourne … her mental health was rapidly declining”.
Magistrate Jacinta Studham said she recognised that Wilder has “battled with an addiction for years”.
“This is serious offending, you were nearly five times the legal limit,” Magistrate Studham said.
“This was a big mistake you made on this day and fortunately no one was hurt”.
The matter was adjourned until October 28 in the Korumburra Magistrates Court.
