A man is denying he struck first during an alleged altercation with another man next door to his parents’ house.

Illyas Dogangon, 37, appeared in the Wonthaggi Magistrates Court on Friday where his legal team claimed his actions were in self defence.

On January 29 this year police were called to a victim’s address who claimed he had been assaulted by Mr Dogangon on his property.

Police allege Mr Dogangon was out on the porch at his parents’ house when the victim arrived home to the house next door about 7.30pm.

There was allegedly a verbal exchange between Mr Dogangon and the victim before the 37-year-old went over to the victim’s property and punched him in the face, leaving him bleeding.

Defence told the court Mr Dogangon had struck the victim in self defence after he was assaulted first.

Magistrate Julie O’Donnell said it was “very hard” to make a ruling on cases that are “word on word”.

However, she did say she was concerned Mr Dogangon had gone to the victim’s property and not the other way around.

“He approached him [the victim] at his address … it is problematic,” she said.

The matter will return to court later this year.
