Sex is complicated and so are our consent laws

A former tiler has admitted to raping his friend’s daughter after he was found bent over his unconscious victim, a court has heard.

The 46-year-old man, who cannot be named, was jailed for six and a half years in the County Court on Thursday after pleading guilty to two charges of rape.

The court heard the father-of-two went to the woman’s house in central Gippsland with her father and boyfriend to do some “handiwork” in 2020.

Once there the victim, 19, and the offender took drugs and drank alcohol over four days with limited sleep.

The victim was seen on CCTV footage “barely walking” and was being held up by the man after returning home from a walk.

She was also captured hysterically laughing because she felt like she was “falling through the grass”.

The court heard later that day the victim’s boyfriend found the grub bent over his girlfriend, who appeared to be unconscious.

He shouted at the man, saying: “You’re seriously f*cking my girlfriend in my own home?”.

The woman’s pants were pulled down and the accused was thrusting on top of the victim.

He then went to the kitchen to get a knife and stab his girlfriend’s attacker, before her father talked him out of it.

When he returned the man was sitting in a camp chair, holding the victim’s head which was positioned in his lap.

The court heard the boyfriend saw her legs were bent at a “weird angle”, her arms were limp and she wasn’t making any movements.

“Get the f*ck out of my f*cking house, you f*cking raped her you dog c*nt,” the boyfriend said.

To which the accused said “no I didn’t”, pulled his pants up and walked outside.

He was arrested a day later and has remained in custody since.

Judge Peter Lauritsen said the offender’s drug addiction was so “well entrenched” he was “truly exercising free will” at the time of the offending.

He also said his criminal history suggests his drug dependence needs to be addressed.

“You’re problems started before May 30, but you have done little about it,” the judge said.

He will be eligible for parole in four years and seven months.
