Oscar winner Jamie Foxx has reacted to a sexual assault claim brought against him in a new lawsuit.
Foxx, 55, is accused of sexually assaulting a woman in New York in 2015.
According to the lawsuit, obtained by TMZ, Foxx allegedly touched the plaintiff inappropriately during an evening at celeb hotspot Catch NYC & Roof in August of that year.
She alleges that Foxx placed both hands on her waist before allegedly touching her inappropriately.
Foxx then allegedly slid his hands into her pants before allegedly groping her.
According to the Daily Mail, a spokesman for Foxx denied the allegations.
In statement to the publication, the spokesman said: “The alleged incident never happened. In 2020, this individual filed a nearly identical lawsuit in Brooklyn.
“That case was dismissed shortly thereafter. The claims are no more viable today than they were then.
“We are confident they will be dismissed again. And once they are, Mr. Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for refiling this frivolous action.”
The woman claims the alleged assault stopped once her friend saw what was going on.
She is suing Foxx and the restaurant for compensatory and punitive damages, claiming she had to undergo medical treatment and suffered emotional distress.
Meanwhile, a former model has accused Guns N’ Roses frontman Axl Rose, 61, of a violent sexual assault 30 years ago in a lawsuit filed in New York supreme court.
Former Penthouse model Sheila Kennedy, now 61, alleges in a filed court claim that Rose sexually assaulted her and that she “did not consent and felt overpowered”.
The assault allegedly took place in February 1989 after Kennedy first met the rocker at an unnamed New York City nightclub, the claim states.
Kennedy had been invited to the club by a friend who was a Guns N’ Roses fan but, according to the complaint, the model was not that familiar with Rose or his band.
After meeting Kennedy, Rose allegedly invited her back to his hotel room on Central Park West but did not want her friend to come along because the woman was “not hot enough” for his taste,” according to the filed claim.
According to the complaint, Rose provided cocaine, champagne and other alcohol for his guests, including Riki Rachtman, then host of the MTV show “Headbanger’s Ball”.
Rachtman is not accused of any wrongdoing, nor is he party to the suit.
But things allegedly took a dark turn as Rose had the hotel suite cleared of everyone except himself, Rachtman, Kennedy and another female model.
It’s alleged all four got into bed and Rose allegedly began having sex with the other model in an “aggressive way” that “appeared painful” for the woman.
The complaint alleges that Rose then tied a bleeding Kennedy’s hands behind her back with pantyhose and appeared to be in a “sexual, volatile rage” as he attacked her, “forcibly penetrating” her without consent.
“He treated her like property used solely for his sexual pleasure,” the complaint says, adding that Kennedy was left with “lifelong emotional, physical, psychological, and financial impacts.”
“The encounter quickly became not just uncomfortable but disturbing.”
The civil case calls for Rose, whose real name is William Bruce Rose, to face a jury trial, and Kennedy to be awarded “punitive damages”.
However, Rose’s lawyer Alan S. Gutman said: “Simply put, this incident never happened. Notably, these fictional claims were filed the day before the New York State filing deadline expires.
“Though he doesn’t deny the possibility of a fan photo taken in passing, Mr Rose has no recollection of ever meeting or speaking to the Plaintiff, and has never heard about these fictional allegations prior to today. Mr Rose is confident this case will be resolved in his favour.”
No criminal charges have been laid yet, nor any suggestion that police are investigating.
Rose, lead singer of the heavy rock band famous for albums like “Appetite for Destruction,” has yet to comment publicly.
However, he attended the Las Vegas Formula One Grand Prix over the weekend, ahead of the complaint being lodged with a New York court.
