An Argentinian prosecutor has been denied in their bid to charge energy millionaire Rogelio “Roger” Nores with abandonment after a judge ruled they lacked jurisdiction in the case.

Court documents obtained by TMZ show national prosecutors attempted to lay the charge of abandonment but were blocked by the judge who found such a charge would need to be made by local prosecutors.

Mr Nores, 35, has denied any wrongdoing.

“I never abandoned Liam. I went to his hotel three times that day and left 40 minutes before this happened,” Mr Nores told the Daily Mail in a statement earlier this month.

“There were over 15 people at the hotel lobby chatting and joking with him when I left. I could have never imagined something like this would happen.”

Mr Nores was not at Payne’s funeral last week with multiple media reports suggesting the family asked him not to attend.

The court documents show the Argentinian prosecutors interviewed Payne’s dad Geoff who told them Mr Nores volunteered to take over Payne’s care in May which involved keeping him sober and out of trouble.

The documents stated at 10pm the day before Payne died he ordered four bottles of whiskey to his room, followed by five more at 6.36am the morning of his death.

At 7am he texted Mr Nores about his intention to hire sex workers, followed by a 9.32am request that read “Can you get 6 grams?” the documents read.

The documents further allege Payne was drinking whiskey when Mr Nores joined him for breakfast the morning of his death and a maid at the hotel who cleaned up his room during the meal noted it had been trashed.

The same maid told prosecutors she saw Payne looking for something before eventually finding a “powder”.

Payne’s final hours are recapped in the new court documents – the 11.30am arrival of the sex workers, a 2pm request for “another 7 grams for today” from hotel staff, Mr Nores’ 3.45pm appearance at the hotel to pay the sex workers and his 4.04pm departure.

At 4.25pm the court papers show Mr Nores texted Payne “How are you?”.

Payne never responded to the message. He fell from the hotel balcony at 5.07pm on October 16.

Payne, whose voice features on the 2024 version of the song, died aged 31 on October 16 after falling from the third-floor balcony of a hotel in Buenos Aires, Argentina, while under the influence of drugs and alcohol.

Geldof, who lost his ex-wife Paula Yates and his daughter Peaches to drugs, went on BBC Radio 2 to air the track for the firs time.

Also featured on the song is the late Sinead O’Connor.

Ball said she and Geldof “both had a cry.”

“Liam, I mean, I was thinking about it at the funeral and I just thought well he’s here, he’s here with his mates, he’s alive with us. He’s doing it for others,” said the Irish singer-songwriter.

It comes as Payne’s One Direction bandmate Zayn Malik was the most recent star to pay tribute to Payne at his first show since the former bandmate’s tragic death.

The homage came in the form of a giant slide projection which said ‘Love You, Bro’ with a heart emoji on stage at the O2 Academy Leeds in West Yorkshire on the weekend.
