The owner of one of the Gold Coast’s most luxurious penthouses is battling to evict a well-known construction company boss, who failed to pay the rent on time.

The owner of one of the Gold Coast’s most luxurious penthouses is battling to evict a well-known construction company boss, who failed to pay the rent on time.

Danny Isaac, managing director of Descon Group Australia, moved into the lavish two-level sky home at Ultra Broadbeach, for rent of $5000/week, in September last year.

Owner Jodie Miles said late rent payments began five to six weeks after Mr Isaac moved in.

“We’ve been trying to get him out since about six to eight weeks from when he got there,” she said.

A notice to remedy breach and a notice to leave was issued to Mr Isaac by property managers Kollosche in November and December last year.

Ms Miles said the arrears were brought up to date in December, and their property manager said Mr Isaac had signed a deed confirming payment to be at least one month in advance.

A weekly direct debit was set up, however, Ms Miles said payments went back into arrears early in 2023.

The couple offered to cancel the lease, without penalty to Mr Isaac, after the rent trouble began.

“We were basically saying `just give us our property and get out’,” Ms Miles said.

“We said he could negotiate a reasonable exit, he’s obviously having problems, walk away and we’ll rescind the lease – but he didn’t have the common courtesy to do that.

“We would like to exercise other options for the property, such as use it for our own family’s enjoyment, however, we are in limbo awaiting Mr Isaac’s departure.”

Ms Miles said the matter was now likely to require resolution in court.

Responding to the claims on Friday, Mr Isaac sent the Bulletin a trust account receipt showing he’d made a $10,000 payment for the property, which represented rent due to March 1.

Further answers to the Bulletin’s questions came via lawyer Clint Kanther, who said “the matter concerned a trivial amount”.

Mr Kanther’s email said the arrears “occurred during the Christmas stand-down period when our client was overseas”.

“The alleged outstanding amount was paid within days of the notice being brought to our client’s attention along with a further four weeks in advance,” Mr Kanther said.

“The incident occurred months ago and our client continues to occupy the residence.”

Mr Isaac’s Descon Group Australia was contracted to build the billion-dollar tower Victoria & Albert towers in central Broadbeach, but left the project last month.

Descon is also no longer the contracted builder on Roberto Badalotti’s $2.3bn Imperial Towers project at Southport.
