AN alleged associate of notorious crime gang the Bra Boys punched a man five times in the head during an altercation with his brother in a Gold Coast bar.

Allen Horsfield left Matthew Guest with a fractured jaw after the fight at Komune in Coolangatta just after 7pm on October 7, 2018.

Horsfield, 28, pleaded guilty in the Southport District Court on Thursday to grievous bodily harm.

Judge Catherine Muir sentenced him to three years in prison with immediate release on parole.

“It is best described as excess self-defence of another,” she said.

“It doesn’t take a long bow to conclude this would have been very frightening for the complainant.”

Judge Muir also ordered he pay $5000 in compensation.

Crown prosecutor Michael Mitchell told the court Mr Guest had been bothering Horsfield and his group, including Horsfield’s brother Tyrone Horsfield.

Mr Guest kept saying one of the group looked like a famous rugby league player.

Tyrone pushed Mr Guest into the pool.

When Mr Guest got out, he and Tyrone Horsfield began to fight and wrestle near the edge of the pool.

Allen Horsfield, who lives in NSW, tried to separate them and then punched Mr Guest in the face.

The punches were so hard it left Mr Guest with a fractured jaw. He had five weeks off work.

“It is accepted there is an element of defence of another,” Mr Mitchell said.

He said the five punches, however, were excessive.

Allen Horsfield told a security guard: “Sorry for causing trouble but when someone messes with my brother I can’t allow that to happen.”

He has been convicted twice previously of violent offences.

Defence barrister Marty Longhurst, instructed by Moloney MacCallum Abdelshahied Lawyers, said Mr Guest had been “annoying” Horsfield and his group before the altercation with his brother.

“My client doesn’t king hit – he tries to pull him off, and it’s only when they can’t pull him again that my client uses a number of punches,” he said.

Mr Longhurst said Horsfield believed his brother was in danger given how close they were to the edge of the pool.

“He is very over protective of his brothers,” Mr Longhurst said.

Since the incident Horsfield had undergone anger management counselling.

Horsfield works as an mentor to indigenous children and works with young offenders in schools.
