A convicted criminal who bashed a woman and attempted to take off in her car just weeks after he had been released from custody, has been sentenced.
Jye Barton Jade Juler, 29, appeared via videolink from custody at Southport District Court on Tuesday where he pleaded guilty to wilful damage, common assault, unlawful entry of a vehicle for committing an indictable offence in the night and grievous bodily harm.
The court heard that Juler met the female victim while attending a gathering on October 20, 2023 exactly two weeks after he had been released from prison, having served time for bashing up his then-girlfriend in 2022.
Juler, along with the victim’s friend and the friend’s brother, was driven by the woman back to her Nerang home where they continued drinking in her living room.
After a glass bottle was smashed at the property, Juler became aggressive and punched a wall. He and the remaining guest were then asked to leave.
A short time later, the brother returned to the house to say he left his phone inside and that he couldn’t find the woman’s friend.
The woman drove the brother and Juler around to find her friend and arrived at Varsity Lakes around 2.30am, where Juler told her to get out of the car and help them look.
She stood outside her car but Juler stood over her, yelled “where the f*** is she?” and shoved her against the vehicle.
The woman told Juler to stop but he punched her twice in the left side of her face, causing her head to slam back onto the top of the car. He then threw her to the ground and while she was unconscious next to the car, Juler entered her car and tried to start it multiple times.
The court heard that Juler told his friend at the scene words to the effect of: “Sorry, I’m a piece of sh**.” and “I want to go back to jail.”
The woman, who was taken to hospital, suffered several haematomas to her face, a cut above her eyebrow and fractures to her face. She later required surgery to remove a tooth that had fractured into multiple pieces.
Juler’s lawyer, Haley Robertson, told the court that her client was still a relatively young man and would be supported by his family if released.
The court heard that Juler had been held in pre-sentence custody since October 21, 2023, had a difficult early life as a victim of sexual assault in foster care and suffered a number of psychological disorders.
Judge Deborah Holliday KC noted that Juler pleaded guilty early, had already spent 472 days in custody and after his previous time in prison, had only been out of custody for two weeks in the past four years.
She said she was satisfied that time in incarceration would increase his distress and taken into consideration time already served, sentenced him to three years imprisonment.
Juler will be eligible for parole on February 20, 2025.
