A Gold Coast ex-bikie turned successful podcaster unknowingly sold CBD oil containing a dangerous drug to undercover police, a court has been told.

Brent Simpson – creator of popular podcast The Clink – and Eden Christopher Gall were sentenced in Southport District Court this week in relation to their company Releaf Therapies.

The court was told police found close to 60 bottles of cannabis oil – which contained small amounts of illicit cannabinoid – at Simpson’s Palm Beach property in August, 2021.

Officers also found a small amount of a substance containing cocaine and labels for the CBD oil with the business’ branding.

Simpson, 45, sold two bottles to undercover police for $290 each and offered to supply on another two occasions.

Gall was only sentenced for supplying one bottle of the oil to a friend on June 4, 2021.

The pair were nabbed during a police investigation into an unrelated matter.

The court was told Simpson – who spent four days in custody after his arrest – had a lengthy criminal history and had previously been sentenced to jail for drug-related offences.

His defence barrister Kim Bryson said her client’s company was not run “behind closed doors” and that Simpson was open and cooperative with police during their search.

Ms Bryson said Simpson showed “real rehabilitation” and was now considered a highly valued contributor to the community through charity work and volunteering.

She said the truck driver and father of four’s podcast had been downloaded about 3.5 million times in the past three years, highlighting others who had similarly turned their lives around.

Representing Gall, barrister Tony Kimmins said his client had already been “more than punished” for the single supply, having spent almost three years on strict bail conditions and one day in custody after his arrest.

Judge Katarina Prskalo said the pair were to be sentenced on the basis they held an honest but unreasonable belief that the oil did not contain a dangerous drug.

Simpson pleaded guilty to four counts of supplying dangerous drugs, two of possessing dangerous drugs, and one of possessing an item suspected of being used in the commission of a drug offence.

He was sentenced to three months’ jail, wholly suspended for 12 months. He was also sentenced to the rising of the court – meaning he must remain in the courtroom until court adjourned – for breaching a suspended sentence.

Gall pleaded guilty to one count of supplying a dangerous drug and was released absolutely. No conviction was recorded.
