Gold Coast man slammed for 'disgusting' act

A man who spat at a woman while she was waiting in her car for a property inspection on the Gold Coast has been slammed over the “disgusting” act.

Andrew Douglas Truran had confronted the woman who was parked on Rossmore Street, Nerang about 10.30am on February 27, a court has heard.
“He asked the victim who she was waiting for and told her to p*** off,” police prosecutor Chelsea Thorn told Southport Magistrates Court on Friday, where Truran plead guilty to one count of common assault.

“The two have got into a verbal argument,” Ms Thorn said.

“The victim begun to film the interaction with the male.”

In the footage, played to the court, a shirtless Truran can be heard telling the woman there had been “suspicious” people in the street before he quizzes her as to why she’s there.

“You don’t own this (street), the council does,” says the woman.

“Don’t tell me to p***off – you don’t own the street.”

Truran continues to press her about her business as she pushes back.

“Honey just let me speak for a second,” Truran said.

“Don’t be rude and say ‘I don’t have to’.”

The women interrupts Truran after he refers to her as ‘lady’ – which sparked this outburst.

“Would you let me f***ing speak you stupid woman.”

An enraged Truran then grabs the car window in an act of aggression before hocking up saliva and spitting it through the window at his victim.

Truran’s lawyer Farshad Sarabi of Hannay Lawyers told the court his client was regretful for his actions and had enrolled in an anger management course since.

“He tells me his remorse of how he lost control of his anger and he wished that he could apologise to the complainant,” Mr Sarabi said.

At the time, Mr Sarabi said his client was looking out for his neighbours’ property, where a package had been delivered earlier that morning.

“He was concerned that this vehicle was driving around.

“And had some concerns that the package may be being scoped out by this person.”

In sentencing Magistrate Louisa Pink told Truran the woman should be free to use public spaces without being assaulted.

“You spat in her face and in her eyes which is a disgusting act,” Magistrate Pink said.

“It’s a degrading act. It also exposes her to the risk of communicable diseases.

“She does not have to account for herself to you.”

Magistrate Pink said it was not Truran’s job to “cross examine” those coming and going in the street.

“It doesn’t matter where she is going. She’s a women minding her own business in a public place.”

She said the footage clearly demonstrated Truran had an anger management problem, but also acknowledge that since the incident he had taken steps to address the issue.

Magistrate Pink also accepted the early guilty plea as a sign of his remorse.

Truran was order to undertake 40 hours of unpaid community service and placed on 12 months probation. No conviction was recorded.
