A prosecutor has demanded the case for a bus driver alleged to have killed three passengers and significantly harmed others on the Bruce Highway progress quicker due to its severity.

A Greyhound bus driver accused of killing three people and seriously harming others in a tragic crash on the Bruce Highway in Gumlu was mentioned in court, with a prosecutor demanding the charges be moved along quicker.

Peter Jason Café has been charged with five offences of dangerous driving to cause death or grievous bodily harm, after the bus he was driving crashed on June 30 last year.

No pleas have been entered.

Lawyer Elizabeth Smith from PD Law appeared by phone in the Townsville District Court on Monday on Mr Café’s behalf where she said they were “having difficulties” in finalising funding and were awaiting the outcome of his Legal Aid application.

She asked for an adjournment while the application was finalised and also told the court that while the charges were “technically a Bowen matter” she was content for it to remain in Townsville court.

The crown prosecutor said the prosecution office were seeking to “progress” the charges.

“It involves three deaths and three grievous bodily harms as a result,” he said.

Judge John Coker told the court he could schedule the charges for arraignment in June however Ms Smith asked for a longer period of time.

“It is a significant period of time that has passed,” Judge Coker said.

“There are some issues of an emotive character that are outstanding therefore the expectation is he would be in a position to enter his plea.”

The charges were adjourned to July 4.
