A North Queensland father charged with the hot car death of a little Townsville girl will be brought before a jury.

A North Queensland father charged with the manslaughter of Rylee Rose Black will have his case brought before a jury.

Aaron Danyel Hill, 32, will go before a jury in Townsville Supreme Court on a count of manslaughter after he was on Thursday committed to stand trial by Magistrate Ken Taylor.

Hill is accused of causing the death of Rylee, 3, the daughter of his then girlfriend Laura Peverill (Black).

Rylee died after she was left in the back of her mother’s Toyota Prado, which had been parked in Hill’s driveway, for more than four hours on November 27, 2020.

Her mother is also charged with manslaughter.

Mr Taylor’s decision was handed down after a committal hand-up of Hill’s matter on Monday.

On that date, the court heard Hill and Peverill had been running errands in the Prado with Rylee in a booster seat in the back of the car before returning to Hill’s home.

The pair went inside at 10.30am where they watched TV and ate wings before returning to the car at 2.30pm.

The court was told they were five minutes into the trip when Peverill turned to see Rylee slumped in her seat, and took her to hospital where she was declared deceased.

In court, Hill sat at the bar table with his eyes locked on Mr Taylor, as his decision was delivered following a committal hand-up of the case on Monday.

During the hand-up, Hill’s barrister Claire Grant had argued that prosecutors did not hold enough evidence to form a prima facie case and submitted that the charge be dismissed, and Hill discharged.

Mr Taylor in his findings said for the prosecution to show a prima facie case they needed to show that Hill had breached a duty of care.

“I find there is sufficient evidence to put the defendant on trial …,” Mr Taylor said.

Hill will remain on bail.

A trial date has not yet been set.
