A couple who heard horror stories about selling cars online decided to play it safe but were still met with a “ruthless” attacker.

Scott Nathan Kennedy, 35, was jailed after he shattered the victim’s leg with a metal pole, leaving him with a permanent limp.

During sentencing, the District Court heard the victim’s wife was selling her silver Mitsubishi ASX in August 2022.

Kennedy heard about the car after word was spread through the Indonesian community, which the victim’s wife and Kennedy’s wife were members of.

Kennedy attended the victim’s Munno Para address to test drive the car and his wife contacted the victim’s wife in October to pay a deposit.

“By this time the seller had changed her mind and intended to sell the vehicle to a family member, although this was not conveyed to you or your wife at that time,” Judge Anthony Allen said.

Kennedy went to the victim’s home on October 9, 2022 to discuss the sale of the car.

After the victim told Kennedy that the car was to be sold to a family member, he became aggressive, telling them he had already bought them a thankyou present.

The court heard Kennedy armed himself with the handle of the car’s jack and demanded the victim sell him the car.

“You followed him up the driveway and swung the metal pole towards his legs,” Judge Anthony Allen said.

Kennedy then struck the victim again to his legs, with the third time causing the victim to fall to the ground.

The tibia and fibula of the victim’s right leg were broken into multiple fragments causing bone to protrude out of the skin and he required four surgeries to correct the damage.

During sentencing submissions, Meredith Hennessy, for the prosecution, told the court the victim and his wife were hesitant to use Gumtree or other online platforms to sell the car as they had heard horror stories.

“Tragically (the victim) has experienced his own horror story now, one that has led to a complete alteration to his well being and enjoyment of life,” Ms Hennessy said.

Ms Hennessy said Kennedy’s violence was ruthless and calculated.

Kennedy read out an apology letter to the court at the time, acknowledging what he did was inexcusable.

“I understand the fear and trauma that my actions may have inflicted upon you and I deeply regret it,” he said.

Kennedy said the incident was a serious wakeup call and brought him great guilt and shame.

“The person I was that night is the not the man I want to be remembered as I have a young daughter, a wife and hopefully a growing family in the future who needs a positive, responsible and present father to celebrate life’s wonderful moments with and also support them through difficult times as a stable role model,” he said.

“I understand an apology will not change what has happened and un-right my wrongs, but I do hope you find some sort of peace from hearing this.”

Judge Allen sentenced Kennedy to three years and eight months jail, with a non-parole period of one year and 10 months.
