Mardhu Rosas sentenced for further indecent offending, assault on public transport officers

A man who sexually assaulted a nine-year-old girl in Hungry Jack’s toilets has been given more jail time for even more crimes.

A man who indecently assaulted a child inside an eastern suburbs Hungry Jack’s may not spend more time in jail after he broke into a home, was seen half naked by a child and assaulted two transport workers.

On Tuesday, during sentencing for Mardhu Andrew Rosas, 30, Magistrate Melanie Burton said some of his offending was “out of character”.

Her Honour further said his assault on the two transport staff workers – doing their job in requesting to see his ticket – was “unprovoked, undeserved and your overreacted”.

The Mile End man pleaded guilty to indecent behaviour, serious criminal trespass, theft, drive a motor vehicle without consent and two counts of aggravated assault.

He is currently serving four years in jail for the sexual assault on a girl inside the Firle Hungry Jack’s toilets.

Her Honour sentenced Rosas to 10 months and seven days’ jail for the offending – increasing the total sentence he is currently serving to four years, eight months and five days.

Ms Burton however said Rosas was someone who would benefit from extended supervision on parole, and did not extend his non-parole period of two years and one month – backdated to May 24, 2025.

She declined to order compensation to the victim of the break-in and issued a 12-month drivers licence disqualification.

Previously, the court heard Rosas was “not thinking clearly” when he fled the Firle Hungry Jack’s in May last year and stole a Toyota Rav 4 from a nearby home.“

This was his attempt to get home after the indecent assault that occurred,” counsel for Rosas submitted.

“On that particular day, there were a lot of poor decisions made by Mr Rosas. In our submission, all of those are very much out of character.“

The indecent assault has occurred, Mr Rosas needs a way home, he has come to an empty home, he goes in and gets the keys to the car, and then leaves.”

It was further submitted that, just two days before Rosas indecently assaulted the young girl at Hungry Jack’s, another nine-year-old girl saw him with his pants down at the Mitcham Shopping Centre.“

She asked her mother if she could go to the toilet and (her mother) allowed her to go on her own,” the prosecution told the court.“

She was walking down the corridor approaching the women’s toilet. She saw the defendant in the parenting room – the door was open and the defendant was naked from the waist down.”

Defence counsel, for Rosas, said her client was “heavily intoxicated”, and that there was “nothing nefarious” about his actions.

Last month, the District Court jailed Rosas for almost four years, but said he could apply for release on parole from June next year.

He had pleaded guilty to one aggravated count of indecent assault over the incident at Hungry Jack’s, Glynburn Rd, in May 2024.

At the time, Rosas had believed he was about to be fired and so skipped work, consuming so many drugs he passed out in the restaurant’s male toilet.

Upon regaining consciousness, he followed the girl and her sister into the female toilet, trapped them there and, after the sister escaped, assaulted the girl.Once free, she ran to her father – who confronted Rosas, only for him to flee – and then reported the matter to police.
