A woman smuggled drugs to her boyfriend in prison after he was refused into the Suboxone program, a court heard.

Damian Anthony Green, 45, and Jacqueline Louise Irving, 50, both walked free from court after a prison search uncovered a balloon of buprenorphine strips.

During sentencing, the District Court heard Green was serving a sentence for other offending in October 2022.

Irving, who was in a relationship with Green at the time, attended at the Cadell Training Centre for a pre-booked visit.

“Prior to this visit you, Mr Green, had asked Ms Irving to smuggle buprenorphine strips into the prison,” Judge Ian Press said.

“You told Ms Irving it would be good for both of you, that Ms Irving would receive $1,000 and that you would receive stuff in prison.”

The Department of Correctional Services staff searched her and found a small pink balloon in her pants which contained buprenorphine strips.

The court heard Irving had another package of buprenorphine strips on her but no further search was conducted.

You did intend to use some yourself but you now also accept you intended to sell at least some of those drugs to other prisoners.

The court heard Green’s application to the Suboxone program was refused and he began using it without permission after learning of his mother’s poor health and the death of his two brothers.

“Your use of Suboxone was part of your motivation for your offending although I note you also clearly intended to make a profit within the prison system by selling to other prisoners,” Judge Press said.

The court heard Green had since been accepted into the Suboxone program.

Green, pleaded guilty to drug trafficking and Irving pleaded guilty to one count of introducing a controlled drug into a prison.

The court heard Irving met Green not long after she arrived in the Riverland and they were in a relationship for six years which had now ended.

“Notwithstanding Mr Green was repeatedly in and out of jail, you remained with him hoping that he would change,” Judge Press said.

The court heard Irving would regularly send money to Green and her own financial issues were part of the reason he agreed to smuggle the drugs to him.

Judge Press sentenced Irving to one year and seven months jail, with a non-parole period of 11 months.

Due to her remorse and low risk of reoffending, the sentence was suspended on a $100, 18 month good behaviour bond.

Green was sentenced to two years and five months jail, with a non-parole period of one year and seven months.

He was ordered to serve the sentence on home detention.
