Comanchero bikie Shaun Barry White faces Adelaide Magistrates Court to vary bail for job in Darwin
A bikie who needs a magistrate’s say-so to work in Darwin may have faked his employment documents, a court has heard.
A Comanchero bikie has asked a magistrate to allow him to travel to Darwin for a job that may not even exist, a court has heard.
Shaun Barry White, 36, faced the Adelaide Magistrates Court on Friday seeking a variation to his current home detention bail conditions to allow him to work in Darwin from December 1 to January 30.
Opposing the variation, prosecutor Katerina Parrella told Magistrate Melanie Burton she was apprehensive about the “legitimacy” of the material provided by Mr White’s proposed employer.
“The mobile number provided was, on police systems, attached to an associate of the offender,” Ms Parrella alleged.
“The email address provided on the document … an email was sent by prosecution to that address and we received a bounce-back that said that email was unable to be delivered.
“There’s also some spelling errors in relation to the document provided, as well as a document provided today.”
Ms Parrella requested an adjournment to “assess the validity of the documents”.
Mr White, of Christies Beach, has been charged with being present with two or more criminal organisation participants and failing to comply with his bail agreement.
He is yet to enter any pleas.
Bradley Dittmar, for Mr White, told the court his client was “born and bred in South Australia” and did not pose a flight risk.
Mr White’s employment, he submitted, was “legitimate”.
“If their (prosecution’s) position is that Mr White wrote a fraudulent document for example, then there is going to be very serious consequences down the track to that effect,” Mr Dittmar said.
“We are confirming that this is a genuine offer of employment – we’ve provided as much information as we can in short notice to try and substantiate that.”
On Friday, Ms Burton noted prosecution’s submissions were “reasonable”, but ultimately granted Mr White’s bail variation request “solely for the purpose of employment”.
“I’ve heard brief submissions today that, on Mr Dittmar’s instructions, the employment is legitimate, that he (Mr White) has rental accommodation here and a de facto partner and his child here in South Australia,” Ms Burton said.
“While again I acknowledge that the prosecution concerns raised are reasonable, the time required to investigate those completely would necessitate an adjournment that in some ways defeats the purpose of the application.
“In all the circumstances, I’m prepared to grant the application. Mr White, I’ve taken the assertions of employment at face value, don’t make me wrong on that.”
Mr White’s matter will return to court next month.
