The 21-year-old man from Mermaid Waters was arrested and later charged with assaulting a police officer and obstructing police.

He is expected to appear in Southport Magistrates Court on July 10.

Three patients were taken to Gold Coast University Hospital. A man in his 40s in a serious condition had significant head, abdominal and chest injuries. A man in his 20s was in a stable condition with head injuries and lacerations. While a woman in her 20s was in a stable condition with suspected spinal and chest injuries.

“When I was called last night I thought they were talking about the wrong venue, I thought, ‘No they’re winding me up.’

“I’m dumbfounded as to how this happened. We just want to get the right message out of what really happened – it definitely wasn’t a bar brawl.

Mr Imlach said the incident took place upstairs outside the male and female toilets.

“It’s a good 2m – 2.5m drop,”he said referring to the fall out the window.

“I spoke to my builder before and he said: ‘Mate that’s some serious force to go through that window,’ – he couldn’t believe it. He too asked me if I had the right venue.

“I’m watching the staff clean it up now there’s glass everywhere – it’s a big window, it’s 2.6m by 1.6m.

Mr Imlach said police had been into the venue multiple times since the incident and he understood it was not an active crime scene.

He was hopeful the restaurant would be open for business on Sunday night.
