A magistrate has slammed a defendant accused of a violent assault on the Gold Coast which left a man in hospital with serious head injuries.
Paradise Point man Tristan Mailman, 43, was arrested late Friday night a short time after a 52-year-old was allegedly assaulted and robbed near Main Place, Broadbeach.
The victim sustained serious head injuries including a suspected fractured skull and fractured jaw and was taken to Gold Coast University Hospital where he remains in a stable condition.
Mailman was charged with one count of robbery whilst armed and one count of contravening a police banning notice.
Appearing via video in Southport Magistrates Court on Saturday, Mailman was refused bail after Magistrate Mark Bamberry deemed he was “an unacceptable risk” and “a danger to others in the community”.
Mailman then wailed: “Please your honour, no!” but was shot down by Mr Bamberry.
“Don’t start complaining now,” he said.
“If you think it’s a good idea to get drunk and go around assaulting people …
“Don’t argue with me.
“You’re staying where you are.”
The court was told Mailman was already on bail over allegations of two separate attacks on people over 60 from late last year and he had also been slapped with an order banning him from the Broadbeach Safe Night Precinct.
Appearing on behalf of Mailman, defence lawyer Dayne Baskerville-Hodge of Brooke Winter Solicitors told the court his client was surprised by the severity of the injuries he had allegedly inflicted.
He also said it appeared likely his client was going to spend a “significant amount of time in custody”.
However, Mr Bamberry was not swayed and opposed bail.
“This is now the third assault (and) it strikes me as a continuation of violence against others,” he said.
The case will return to Southport Magistrates Court on March 4.
Police are appealing to anyone who may have witnessed the matter or has relevant CCTV or dashcam of the incident to contact investigators.
