Matthew Alan Warner to face new trial for alleged grievous bodily harm

A new trial has been set for a plasterer who is accused of striking a man and causing him a traumatic brain injury outside a Sunshine Coast venue.

A retrial has been ordered in the case of a plasterer accused of a “king hit” attack outside a Sunshine Coast pub.

Jury members listened to four days of evidence in the Maroochydore District Court in October after Matthew Alan Warner pleaded not guilty to one count of grievous bodily harm.

Despite a nearly week-long trial, the jury was unable to return a verdict and was discharged on October 11.

Mr Warner’s matter was brought before the District Court again for mention on Monday, where Crown prosecutor Alex Stark asked for a new trial date to be set following the hung jury verdict, to accommodate witness availability.

Defence barrister Lachlan Ygoa-McKeown represented Warner who was not present during Monday’s brief mention.

Judge Gary Long set the next trial date to February 24.
