Ex-medical marijuana chair James Anthony Ellingford sues Valley Vibes dance party company

The owners of a collapsed dance party company have been sued by a controversial TikToker and former chairman of a medical marijuana company who recently admitted “menacing” his ex-wife and two daughters.

The owners of a collapsed dance party company have been sued by a controversial TikToker and former chairman of a medical marijuana company who recently admitted “menacing” his ex-wife and two other family members.

James Ellingford has sued ex-dance company owners Keziah Sundah Boag, from Crabbes Creek in northern NSW, and Jordan Whale from Varsity Lakes on the Gold Coast in the District Court in Southport.

He claims the pair misled him about receiving shares in their company when he invested.

In a separate criminal case, Dr Ellingford pleaded guilty to three counts of using a carriage service to menace, harass, or cause offence in Southport Magistrates Court in July and was given a good behaviour bond with no conviction recorded.

He sent his ex-wife and other family members a series of expletive-laden and abusive emails after finding out he was not invited to a family wedding.

Dr Ellingford was the chairman of then-ASX-listed pot company Cresno Pharma, now renamed, until last year, when he was also posting on his TikTok channel @agegap50 and @agegap35 channels with his 23-year-old girlfriend.

He alleges in his claim that Mr Boag and Mr Whale owe him $186,503 he invested in White Noise Entertainment Pty Ltd, which managed the Valley Vibes festival held at the Kooralbyn Resort, in the Scenic Rim, west of the Gold Coast.

White Noise Entertainment Pty Ltd was wound up on March 16.

Dr Ellingford, 58, from Runaway Bay on the Gold Coast, alleges Mr Boag and Mr Whale “misled” him when he invested the $186,503 in July and August last year and they failed to give him shares in White Noise Entertainment Pty Ltd.

He submits that Mr Whale misled him when he claimed White Noise Entertainment was a “highly successful” business, that had been operating for some time and was profitable.

He also alleges Mr Whale misled him when he claimed in early July last year that Dr Ellingford would get a significant return on his investment.

Dr Ellingford alleges that when Mr Whale made these claims the business was “not highly successful” and owed the Kooralbyn Resort Pty Ltd $48,530 which White Noise “could not” and did not pay.

White Noise was wound up last year after Kooralbyn Resort Pty Ltd filed a winding up application in court relating to the unpaid debt, the claim states.

He also alleges Mr Whale misled him when he claimed Dr Ellingford would be a shareholder in White Noise Entertainment Pty Ltd after he invested.

He says he was never given a receipt for the payment of the $186,503 and he has made “several requests” for the shares in White Noise Entertainment Pty Ltd to be transferred to him.

He accuses Mr Boag of representing that Dr Ellingford would be issued shares in the company when he signed the White Noise Subscription Agreement in July last year, the claim states.

The case is in its early stages and no defence to the claims is due to be filed.

No date has been set for hearing.

The Courier-Mail has contacted Mr Boag and Mr Whale for comment.
