Body corporate chairman, wife and dog threatened with death: court

A jury has taken an hour to determine if a unit owner at an up-market resort was responsible for phoned death threats to the body corporate chairman, his wife — and their dog.

A GOLD Coast man has been found not guilty of threatening to kill an up-market resort’s body corporate chairman and his wife — and cut up their dog and feed it to them.

Jade Sky Mark Angangan had pleaded not guilty in Southport District Court to six counts of using a carriage service (phone) to make a threat to kill, and three charges of using a carriage service to menace, harass or cause offence.

The jury retired today and took an hour to deliver the not-guilty verdict.

The court was told William “Andy” Kilpatrick ran the body corporate of the Santai Resort at Casuarina on the Tweed Coast, where Angangan owned a unit.

On February 28. 2017, they were woken by a series of late night phone calls from a “loud and aggressive” male.

When Mrs Kilpatrick answered the first call, the man threatened her: “If anything happens at the (body corporate) AGM tomorrow that affects my client in unit 115, I will kill you, I will kill Andy, I will kill your dog Molly. I will cut her up in pieces and feed her to you first.”

The Kilpatricks allegedly received two more calls in quick succession that night in which similar threats were made, including one in which the caller said: “I know where you live, I’ll kill your whole family.”

The court heard that Unit 115 was leased to a restaurant in Santai Resort.

The jury was told the key issue in the case was identifying who made the calls, which came from a public phone box in Queensland about 20km from Casuarina.

The Kilpatricks testified that they recognised the voice as belonging to Angangan, who they had dealt with on body corporate issues.

In closing submissions, defence barrister Leon Ackermann told the jury the Kilpatricks were unreliable witnesses.

Mr Ackermann said Mr Kilpatrick had failed to mention the threat to cut up their dog to police, and he and his wife had overreached in their evidence.

He said the “final nail in the coffin” in the Crown case was that Angangan had no interest in the restaurant.

Judge Richard Jones told jurors that identification of the caller was the key issue in the case.

“Was it he (Angangan) who made the calls?” he asked.
