The teen ringleader of a youth gang on Sydney’s northern beaches has escaped jail time after leading the horrific attack of a schoolboy who was repeatedly tasered and gutter stomped.

A baby-faced villain on Sydney’s northern beaches is terrorising innocent teenagers alongside a slew of gang members in racially-fuelled onslaughts – and there is nothing police can do to keep him behind bars.

A 13-year-old gang ringleader from the northern beaches has escaped prison time, with the NSW Children’s Court arguing his age meant he “does not have the ability to form criminal intention”, after leading a terrifying gang attack on a high school student who beared the brunt of up to 60 blows to his head and chest on March 18.

Police alleged in a closed children’s court hearing this week, a 15-year-old boy was set upon by a gang of youths in a shopping centre car park after school, before he was thrown to the ground and had his head repeatedly stomped on.

Hospital staff told the teen victim’s family his bicycle helmet was “the only thing to save his life”, protecting his brain throughout the “gutter-stomping assault”.

After initially fleeing the scene, the teen gang returned with knives and tasers, electrocuting the boy in the back and leg before a stranger “stopped her car to save his life”.

The harrowing attack – described as too graphic to be watched in full during court proceedings – was filmed and shared on social media, sparking a manhunt by police.

Three boys, all under the age of 16, were charged with assault causing grievous bodily harm in company.

However, just days before the children’s court hearing was set to take place, police advised the family that charges were expected to be dropped.

The family worked with Pittwater state Liberal MP Rory Amon, who called on the NSW Police to seek an indepedent review in order to Doli Incapax common law.

But the devastated family of the schoolboy victim were told this week by the courts that their son’s alleged assailant was “incapable of committing a crime due to a lack of understanding of the difference between right and wrong”.

The rejection of the prosecution of the boy comes despite a flurry of applications from police prosecutors and more than 10 outstanding, unrelated charges against him.

All 11 charges were dropped.

“Our son is a prisoner in his own home,” the mother of the 15-year-old victim told The Sunday Telegraph.

“He has to be escorted too and from school, under the constant threat of attack and even death from teens loyal to this 13-year-old villain.”

“He and his followers are waging war on innocent children across the Beaches.

“This boy is evil, he preys upon other children, but the police can’t keep him locked up.”

She said her son has to be ferried to and from school and escorted from the classroom to the car as teens hurl abuse at him.

The mother said police worked tirelessly, exhausting all avenues, in their brief of evidence to prove that the teen ringleader “knew what he was doing”.

“This young person has a long history of criminal activity and has since committed a similar serious assault on another boy and other criminal acts while on bail for the attack on our son,” she said.

“At 14 years old, the young person would have been convicted and sentenced. We are taking a difference of a few months.

“In comparison, (the) 16-year-old (coaccused) was immediate imprisoned and after a plea.”

The mother said her son has “received numerous death threats”, with members of the gang allegedly waiting for him outside his school “almost daily”.

“The death threats have include “kerb crushing” where they intend to place his head on a kerbside and smash it until his skull is crushed and he dies,” she said.

“We moved to Australia 4 years ago for a better life for our children.

“This is now a decision we deeply regret and we wish we had never come to Australia.”

An interim apprehended violence order is all that protects the victim from his attacker.

“The police and the school did an amazing job to work to prosecute this case,” Mr Amon told The Sunday Telegraph. “Clearly we have to look carefully at these cases because we can’t have violence incidents like this, where teens get charges dropped as the result of the Doli Incapax common law.
