A 42-year-old man who hit a 20-year-old woman in the neck and throat with a broken glass bottle, causing a 2cm-deep laceration to her jaw, has pleaded guilty to the offence.
Benjamin Alexander Lyons, of Point Clare, pleaded guilty in Gosford Local Court to reckless wounding, as well as stalking and intimidation charges.
According to police facts, on the evening of September 7 last year, the victim, her partner and a friend were at their home in Point Clare when they decided to go for a late-night walk to the nearby Orana Aged Care Facility on Koolinda Ave, which is adjacent to Lyons’ property.
As the young couple walked towards Lyons’ house, he came out and began yelling at them, saying, “What the f--- are you doing?”
The victim and her partner then heard glass smash on the road, and looked up to see Lyons, who was described as “quite drunk”, walking towards them holding a broken bottle in his right hand.
When he was about one to one-and-a-half metres away, Lyons tensed his upper body, squared up to the couple and shouted, “Get the f--- out of here.”
The victim’s partner responded, “What’s going on?”
Moments later, Lyons made a stabbing motion with his arm. During the commotion, the victim pushed her partner out of the way to move between them.
“Lyons then hit the victim on the left side of her neck and throat area with the end of the broken glass,” court documents state, causing immediate pain and prompting her to scream for help.
The victim then heard more glass smash before Lyons allegedly punched or struck her multiple times on the right side of her face and neck, as well as on her left shoulder.
The victim’s partner, who was holding a pocketknife at the time, lunged at Lyons, who threw him to the ground. The victim’s partner is not charged with any wrongdoing.
All three ended up on the ground between the footpath and the kerb near the smoker’s area. Lyons then fled the scene.
The victim and her partner walked to the corner of Koolinda Ave and Brisbane Water Drive, where they noticed a large amount of blood on her shirt and hoodie.
Police and paramedics attended shortly after. At the scene, officers located the base of a broken schooner-style glass underneath a tree, along with what appeared to be blood on the footpath leading to the roadway.
The victim was taken to Gosford Hospital for treatment.
She sustained a 2.5cm-long by 2cm-deep full-thickness laceration to the left jaw, breaching both the epidermis and dermis. She also suffered bruising to the left side of her face, shoulder and right ribs, along with abrasions to her face, neck and hands, which were cleaned and dressed.
Lyons will be sentenced in Gosford District Court at a later date.
