Maxwell Alfred Abel sentenced to nine months jail with immediate parole after two assaults in Surfers Paradise

A CONCRETER who fractured a stranger’s eye socket and assaulted a security guard during a 15-minute violent rampage through the heart of Surfers Paradise has walked from court on parole.

Maxwell Alfred Abel, was jailed for nine months with immediate parole and will only have to pay just over $1000 to his two victims.

Abel, 37, pleaded guilty in the Southport Magistrates Court on Tuesday to two assaults occasioning bodily harm, stealing and public nuisance after the violent attacks in Surfers Paradise this year.

“Your behaviour was quite simply appalling, violent. It was gratuitous violence,” Magistrate Mark Howden said.

“It is the sort of behaviour that the courts have time and time again remarked won’t be tolerated,” he said.

The Southport Magistrates Court was told Abel was refused entry to a Glitter Strip pub as he was too intoxicated about 7.15pm on August 22, 2020.

After he left his smashed a bottle on to the footpath and confronted a stranger, who was out celebrating a 21st birthday.

The court heard Abel swung wildly with a closed fist. It grazed the victim’s face causing him to fall backwards.

Abel left but shortly after returned. This time he began punching the victim to his head and body.

The court was told the victim suffered a fractured eye socket.

“This attack was completely unwarranted,” Mr Howden said. “There was no reason for it.”

Ten minutes after the assault, Abel muttered something as he walked past a security guard on Cavill Ave.

After a brief interaction between the pair, Abel punched the security guard to the chest and pushed him into a wall.

The security guard fell to the ground and Abel took off with his prescription glasses.

Mr Howden accepted the incidents were an “aberration” and that Abel was doing something to address his problems.

Abel’s solicitor Michael Gatenby, of Gatenby Criminal Lawyers, said his client was apologetic.

The court was told he had recently moved to Queensland from Victoria for a fresh start following the breakdown of his romantic relationship.

Mr Gatenby said Abel had struggled with mental health issues for which he was receiving help.

The court was told he had no previous criminal history and was a good worker, who had previously owned a concreting business in Victoria.

Abel was ordered to pay a combined $1120 in compensation for the two assaults.

For stealing and public nuisance he was fined $350. No convictions were recorded for the stealing and public nuisance.
