A Kingston dad and football player has landed in court after smashing a beer bottle on the back of his neighbour’s head during a heated fight over a noise complaint.

A Kingston dad has landed in court after smashing a beer bottle on the back of his neighbour’s head during a heated fight over a noise complaint.

Vincent Tupe Faamoana, 28, pleaded guilty in Beenleigh Magistrates Court on Friday to assault occasioning bodily harm while armed.

The court heard the young dad had been drinking all night before he got into a heated argument with his 52-year-old neighbour and assaulted him at about 8.50am on April 3, 2021.

Police prosecutor Sergeant Rochelle Paz Landim said the victim had been speaking to another neighbour in his front garden when Faamoana approached him.

The victim was complaining about the loud music playing at Faamoana’s home during the early hours of the morning.

“The defendant left his house with two friends and walked over and stood on the nature strip in front of the victim’s house, and they spoke over the fence,” Sgt Paz Landim said.

“The defendant asked the victim why he was talking about him. Then, the victim and defendant talked about the noise complaint.

“The victim became upset and told the defendant: ‘Go and get f****ed’ and turned around.

“At this point, the defendant threw a glass stubby containing beer into the back of the victim’s head, shattering on impact and breaking the victim’s skin.”

The court heard the entire incident was captured on CCTV outside the victim’s house.

Faamoana’s lawyer told the court his client was a father to four who worked as a packer, played local rugby league and was involved in his helping his son’s team.

He said he received treatment for anger management shortly after the incident.

“The backstory behind the offending is that it was Easter weekend, and they had been drinking on the evening of Good Friday with some friends and family; they had some music playing,” the lawyer said.

“The neighbour, who was ultimately the victim in this matter, went over to the house on Friday night and had words with them about how they were playing loud music.”

Magistrates Tracey Mossop described Faamoana’s offending behaviour as “appalling.”

“Neighbours have a right to quiet, peace and enjoyment, and they have a right to talk to other neighbours about the disturbance the night before,” she said.

“When you walked over and behaved the way you did, you clearly had been up all night drinking and had no consideration for anyone but yourself.”

He was sentenced to seven months imprisonment with an immediate parole date.

He was also ordered to pay $500 in compensation to the victim.
