A Logan uber driver charged with allegedly raping his daughter has been granted bail in court despite the alleged victim stating she was ‘petrified’ for her safety.
The 34-year-old man, who cannot be named to protect the identity of the alleged victim, was charged with five counts of indecent treatment, attempted rape and rape, for offending with two girls — one of them his daughter.
He was granted bail in Beenleigh District Court on Friday, March 31 under strict conditions.
He must not contact the two girls, must report to police and not socialise with any child.
The court heard a night time curfew was suggested but would have caused an issue for the man’s job as an uber driver.
Judge Craig Chowdhury did not attach a curfew time to the conditions as he granted bail for the man.
“No grant of bail is risk free. No civilised society can lock people up as they are awaiting trial and presumed innocent,” said Judge Chowdhury.
“No doubt they are serious charges but there is no independent evidence to support them.
“This is common as these type of offences often occur in secret.”
The court heard the man’s former partner had allegedly pressured one of the girls to drop the charges
Defence lawyer Jack Kennedy disagreed and said there was no DNA or eye witnesses and his client was willing to comply with bail conditions.
“My client is not responsible for what the mother does,” he said.
“There is nothing to suggest he is at risk of committing further offences and he is willing to abide by strict conditions.”
The court heard the man had been in custody for nine months and had a trial date set for November.
