Accused Comanchero bikie Matthew Kevin Mackay denied bail despite dad’s $200k surety

After his offer of $100,000 surety was rejected, the father of an alleged Comanchero bikie accused of robbery and deprivation of liberty has doubled his money, but with no success.

Accused Comanchero bikie Matthew Kevin Mackay has been denied bail by a Beenleigh magistrate despite his father offering the court a $200,000 surety.

Mackay has been charged with offences including misuse of drugs and pipes, contravening a police direction, deprivation of liberty and robbery after being charged on Saturday.

Police alleged the offences related to an incident in March.

Mr Lucey has been charged with offences relating to that incident, including arson, receiving tainted property, unlawful use of a motor vehicle and acts intending to cause grievous bodily harm.

Prosecutor Harry Coburn told Magistrate Cameron McKenzie today (June 5) that police picked up Mackay on a warrant after he failed to appear in court on other, alleged minor charges.

Mr Coburn provided new evidence in the matter, including screenshots of alleged communications between co-accused bikie Joshua John Lucey and a witness.

Mackay’s defence lawyer, Corey Cullen, told Mr McKenzie his client was not involved in the message exchange.

“To be clear, those messages don’t involve my client and he is not a party to those messages,” Mr Cullen said.

“It is the case certainly that there are no statements from either witness that was mentioned in the objection to the bail issued and that the matter will have to go through the process of a committal cross-examination, given some of the information that has been divulged.

“The main issue is credibility as well. He (the co-accused) has a relative criminal history so it is certainly a matter that will experience delay.’’

Mackay’s father David, who owns a tip truck company, earlier offered a $100,000 surety for his son’s release.

Mr Cullen told Mr McKenzie this could be increased.

“I initially said a $100,000 surety would be provided. I’ve spoken with my client’s father — that can be increased to a $200,000 surety,’’ he said.

“He (Mackay) can report to the Fortitude Valley police station for as many days as required.”

Mr Coburn told the court that while the screenshots were from Mr Lucey’s phone they were corroborative of the victim’s version of events.

“The defendant is a key part of the Comancheros expanding their criminal empire,” he said.

“Furthermore your honour, that circumstance of aggravation means the court must impose at least seven years’ imprisonment, so it is not a case of the defendant being at risk of serving too much time.”

After some deliberation about the new evidence presented, Mr McKenzie denied Mackay’s bail application.

The matter was adjourned to June 15 in Cleveland Magistrates Court.
