A woman has outlined being obsessively stalked by a man who threatened to share intimate videos of her to adult websites, a court has heard.
Damien Juegan, 47, pleaded guilty in the Geelong Magistrates’ Court on Thursday for the sustained stalking, threats and harassment of a victim over a three-month period, along with possessing anabolic steroids.
The court heard Juegan, from Footscray, subjected the woman to a barrage of calls, messages, emails and voicemails, and used other means in an “obsessive attempt” to control and exert power over her.
In a victim impact statement tendered to the court, the woman said she lived in fear the accused would release photos and videos of her to pornographic websites, outlining severe psychological and physical effects of abuse.
According to court documents, Juegan sent messages to her on April 5 saying “F***ing a******. Keep an eye on Youporn our videos will be on there.”
The following day, he messaged “say something immediately before I put our videos on Youporn. I’m serious I’ve f**** had enough.”.
He also claimed he had uploaded seven intimate videos of her to the same adult website on April 16.
Between February and April, he attempted to call her more than 400 times, sent over 200 emails and was seen loitering around her work.
He also threw a tennis ball on her balcony with the words “please talk” and “I (heart) U” written on it.
On one occasion the victim was so scared he would come to her house she moved her vehicle, closed the blinds and switched off her lights.
She now suffers from a stress rash, panic attacks, fatigue, insomnia, shame and embarrassment, the court heard.
The woman said her abuser was “obsessed with sex” and would often call her a “pig” a “w****” and a “s***”.
Juegan’s defence barrister, Mel Cox, told the court the father-of-two was remorseful and was “well thought of” as a full-time construction worker.
Ms Cox said her client had an “inability to self regulate and control his impulses” and had a “hyper fixation on her” potentially caused by ADHD.
Juegan now lives with and cares for his elderly grandparents, the court heard.
The court heard he had priors for using a carriage service to harass the victim.
Magistrate Ann McGarvie said it showed a “concerning pattern of behaviour”, stating he would have been jailed if not for his guilty plea.
“I have wrestled over what to do with your offending, given the seriousness of stalking and the fact it is a common crime we now see,” she said.
“I am sparing you jail this time, but if you come back again you will definitely serve a term of imprisonment.”
She said his offending has had a profound effect on his victim, who she agreed had suffered “significant emotional and psychological harm” as a result.
He was convicted and placed on a three year Community Corrections Order.
Regular supervision and programs will be in place to reduce the risk of reoffending, the court heard.
