THE father accused of murdering the baby girl that washed up on Surfers Paradise beach last month is “the son of god” and should be “free from his chains”, court documents allege.

In documents lodged in the Tweed Heads Local Court, the girl’s 23-year-old mother claims her 47-year-old partner slew the devil and “did what had to be done”.

“I was not there when the babe was sleighed (sic), it was not for me to know, or my burden to bare,” a note in her diary allegedly reads.

“Though shalt not murder is his command but (the father) is the law himself, he is the word and the son of god.

“He had the right to sleigh (sic) the wicked one for all nations sake. He did what had to be done, hallelujah to the living son.”

Another scribbling in the diary states she wants the father to be freed, it is alleged.

“Free the black man from his chains for he is innocent I do say.

“For he did slay the one you call the devil she/he was hiding in an infant a child abomination he/she is, thought he could escape judgment,

“Thought he could take from the lord again for he did put a stop to it she was the haw of Babylon the root.”

The mother was released on bail today after appearing via videolink at the Tweed Heads Local Court.

She was granted bail on the condition that she attend all medical appointments and take prescribed medication while attending a mental facility in New South Wales.

The woman faces a maximum of five years in jail after being charged with failing to provide for a child cause danger of death between 6.30pm and 7.30pm on November 17 at Tweed Heads.

She entered a plea of not guilty on Friday.

The father of the child has been charged with murdering the nine-month-old during that time at Tweed Heads.

The woman appeared via videolink from Grafton Correctional Centre and looked alert as she leaned forward with her hands clasped in front of her mouth as she waited for the verdict from Magistrate Jeff Linden.

He hair was dark, skin pale, and her arms looked thin in her long sleeved green jumper.

Magistrate Linden set strict bail conditions for the mother.

She won’t be allowed to speak to witnesses, be in Tweed Heads and must report to police once a day.

Defence lawyer Tom Ivey said the mother would be in acute care for possibly as long as 12 months.

“I have spoken to her parents and they are very supportive,” he said.

“They are flying to the area very soon and will help her settle in to the facility.”

Police prosecutor Val Short said police were against releasing her on bail.

“My instructions are to formally impose bail on the grounds there was no fixed place of abode,” she said.

“There is also a history of noncompliance of mental treatment, there has been previous noncompliance of prescribed medication.”

Police allege the family spent a few hours at the “aunty’s” Kingscliff unit on November 17 before catching a bus to Tweed Heads.

That night, the father, 47, is accused of leaving the baby’s mother and her other child in the car park of the Tweed Mall for 30 minutes while he dumped the baby — wearing only a nappy — in the nearby water.

After he returned, the homeless family sought shelter from bad weather for several hours before catching a bus from Wharf St, Tweed Heads, to Broadbeach, court documents allege.

Just over 24 hours later the baby’s body was found washed up on Surfers Paradise beach, 30km north of Tweed Heads.

The father of the child has been charged with murdering the baby after police allege he threw her into the Tweed River on November 17.

The bail was allowed and the matter was adjourned to January 25.
