Kyle Luke Young appears in court accused of Surfers Paradise bashing attack on Matthew Donovan

Gasps were heard in a Gold Coast courtroom today as video footage of an alleged attack was shown, with a magistrate saying what he saw was “violent, vicious and unprovoked”.

A FORKLIFT driver accused of “violently” and “viciously” beating a man outside a Surfers Paradise toilet block has been granted bail.

Kyle Luke Young, 26, was silent as shocking CCTV footage of the “unprovoked” attack was played to the Southport Magistrates Court today.

Young is charged with one count of grievous bodily harm.

The court was told Young has previously been convicted of common assault in 2010.

The CCTV footage showed the 33-year-old alleged victim, Matthew Donovan, waiting outside the Ferny Ave toilet blocks when a man comes and kicks him in the chest about 1.30am on Friday morning.

A second man, alleged to be Young, then punches Mr Donovan to the ground, the footage showed.

In the footage the man alleged to be Young and two other men walk off only for Young to allegedly return and punch Mr Donovan again.

The footage shows Mr Donovan trying to sit up only for the man alleged to be Young to return again and kick him in the head.

The three leave while Mr Donovan lay unconscious on the ground, the footage shows.

It is alleged Young and Mr Donovan did not know each other.

It is not clear what started the alleged incident.

No one else has been charged in relation to the alleged attack.

As the footage played, people watching in the public gallery gasped audibly.

An application to the court by the Bulletin to obtain a copy of the footage was refused.

Magistrate Ron Kilner, who granted bail, said what he saw in the footage was “reprehensible”.

“What I saw was violent, vicious and unprovoked to any sane thinking person,” he said.

Magistrate Kilner said it was not up to him to determine guilt.

He said there was more to consider than the seriousness of the offence when granting bail including the man’s likelihood to reoffend and whether he will appear in court.

Magistrate Kilner imposed stringent bail conditions on Young including a curfew between 8pm and 6am, that he live with his parents in Arundel, he report daily to police, he not contact Mr Donovan or witnesses and he not leave the Gold Coast.

Prosecutor Joel Sleep told the court Mr Donovan remains in Gold Coast University Hospital in intensive care suffering a traumatic brain injury, fractures to the skull and in need of a facial reconstruction.

Mr Sleep said police tracked Young through Surfers Paradise via CCTV to Cocktails Nightclub where he was arrested.

He tendered to the court photos which showed blood on Young’s ankle.

Defence lawyer Skye O’Dwyer, of Allen & Searing Criminal Lawyers, said Young suffered from ADHD and bipolar disorder.

She said Young also had a problem with alcohol.

Ms O’Dwyer said Young was usually a forklift driver but had trouble finding work lately so was working spray painting cars with his father.

The court was told Young moved to the Gold Coast from Brisbane about a year ago.

The matter was adjourned to December 5.
