Gold Coast bikies: former Bandido Brett Daniel Boyden pleads guilty to wearing an old jumper with prohibited gang name

THROWING on a jumper to get a late-night snack after a “hard day’s work” has cost a former Bandido bikie $500.

Brett Daniel Boyden, 35, pleaded guilty to wearing or carrying a prohibited item in a public place in the Southport Magistrates Court today.

The court was told Boyden was caught by police wearing a red jumper with the words “Bandidos Centro” while he went for an orange juice and sandwich at a 7/11 convenience store at Nerang. The jersey also included the prohibited “1%” symbol.

The maximum penalty for the offence in Queensland is six months in prison.

In Queensland it is illegal to wear outlaw motorcycle club colours. The laws were introduced to curb violence and organised crime.

At 11.55pm on July 14 last year, Boyden had just finished a long day moving houses from Mermaid Beach to Nerang when he decided to grab dinner, defence lawyer Campbell MacCallum, of Moloney MacCallum Abdelshahied Lawyers, explained.

“He instructs that he was going to go out to the service station quickly for what he describes as a sandwich and a drink of orange juice,” Mr MacCallum said.

“He said he was looking around in some boxes, put on a jumper. He didn’t think there would be anything wrong with it given he was only going to step into the 7/11 service station.”

But police officers had arrived at the service station.

“Unfortunately for him and fortuitously for the police they too were at that particular service station obtaining a snack while on their shift.”

Mr MacCallum told the court Boyden, who renounced his membership with the outlaw motorcycle gang in the wake of the infamous 2013 Broadbeach brawl, co-operated with police.

He said Boyden did not “instil any fear in the public while wearing the jumper” and had a pleasant exchange between the cashier at the service station.

Magistrate John Costanzo said Boyden’s offending was at the lower end of the scale for the offence and fined him $500 which is 10 per cent of the maximum fine.

Boyden’s older brother Nathan also appeared in the same court where he pleaded guilty to possessing explosives, producing dangerous drugs and unlawfully taking electricity.

The court was told the 37-year-old was caught in a raid last October with 24 immature cannabis plants and 368 rounds of ammunition.

Mr MacCallum said he had no previous criminal history and said the cannabis apparently helped with what he said was back pain. Mr Costanzo fined Nathan Boyden $5000.
