Daniel Luke White Mayne found not guilty of attempted murder charge

A man charged with attempted murder following a shootout with cops at a Gold Coast car park has been found not guilty by a jury. But he has been found guilty on a lesser charge.

A Queensland jury has found a man not guilty of attempting to kill a police officer in a Gold Coast car park after she shot him in the scrotum.

But they found Daniel Luke White Mayne guilty of an alternate charge of attempted striking to resist arrest.

The verdict came after White Mayne, 28, was tried in the Brisbane Supreme Court for more than a week for attempting to murder Constable Diane Dorothy Squires in January 2017.

White Mayne was shot through the thigh and scrotum by police after a routine arrest escalated in the underground car park of the Solaire Apartments building in Surfers Paradise.

The trial heard Const Squires thought she was going to die when her gun jammed after firing at White Mayne multiple times when he pulled a revolver on her and partner Constable Simeon Pickering.

Body camera footage taken by Const Pickering played on the first day of the trial recorded the sound of multiple shots being fired.

Prosecutors said Const Squires shot at White Mayne four times, hitting him twice, with one bullet piercing his thigh and scrotum and another going through his foot.

After being wounded, White Mayne fired a single shot at the officer, the trial heard.

Defence barrister Angus Edwards said while White Mayne was “no angel”, he never intended to kill the officer.

White Mayne consistently claimed in later police interviews “he was just trying to scare them so he could get away”, Mr Edwards said.

After the jury delivered the verdict on Thursday, the matter was adjourned to May 24 for a mention in the same court to determine a date for sentencing. White Mayne remains in custody.
