Craig Edward Carroll allegedly assaulted woman with tomato for being ‘promiscuous’ and ‘teasing’

A Toowoomba man who alleges he fought off a ‘promiscuous woman’ with a tomato after she made unwanted advances toward him has fronted court charged with assault.

A Toowoomba man has faced court for allegedly throwing a tomato at a woman who he said wouldn’t stop making sexual advances towards him.

Craig Edward Carroll fronted Toowoomba Magistrates Court on Tuesday, September 23, on six charges – one of which was assault regarding the alleged tomato incident.

He was also charged with possessing a category A, B, or M weapon, graffiti, possessing a used drug utensil, and two counts of stealing.

When Mr Carroll’s case was mentioned he told the magistrate he didn’t want to see a duty lawyer and he wanted to plead guilty to the charges.

“It’s OK, I’ve been to court a lot now,” he began.

“I just thought it would be easier (to plead now).”

Magistrate Mark Howden noted the 31-year-old man had one charge of common assault.

Mr Carroll told the magistrate the assault charge related to an alleged incident involving a “promiscuous woman” and a tomato.

“Yeah, the common assault on a female, it was just because she was acting promiscuous and trying to tease me towards herself,” he said.

“Then I got a bit drunk, intoxicated, and was silly and threw a tomato at her.

“Nothing to really impair her or hurt her but just to kind of retaliate to her, um, actions.

“I know it’s hard to explain… to you know why I would do such a silly thing.”

Police prosecutor Nicholas Pratt informed the magistrate that “Mr Carroll might be in jeopardy” of a jail term.

“He’s on a suspended sentence for assault occasioning bodily harm from Hervey Bay, May of last year,” he said.

Flicking through Mr Carroll’s criminal history, Mr Pratt said he had been dealt with for a number of assault charges.

“It’s perhaps more serious than it seems at first blush,” he said.

Mr Howden urged Mr Carroll to get legal advice and stood the matter down.

After hearing he was at risk of being sentenced to a term of imprisonment, Mr Carroll indicated he was acting in self-defence.

“For what it’s worth she’s almost assaulting me,” he said.

When his charges were again mentioned an hour or so later, acting duty lawyer Alysha Jacobson told the court Mr Carroll was applying for Legal Aid and had the matter adjourned.

The case will next be mentioned in court on October 22.
