CLOSING time of a proposed tavern has given the Gold Coast City Council a headache that ended up in court even before construction started on the venue.
The council and Pimpama Commercial Pty Ltd needed to head to the Planning and Environment Court to determine when the proposed tavern, a part of a development in Dixon Dr, Pimpama, should close.
Developers wanted the ability to serve alcohol until 2am and for patrons to gamble until 4am.
The council wanted the tavern to call “time’’ and cut off the fun at midnight.
When built, the tavern will include a sports bar, gaming room, bistro and beer garden.
Judge Richard Jones ruled the tavern should be able to remain open until 2am.
“I am satisfied that the extension of trading hours from 12am to 2am would … result in positive social outcomes and would meet a community need and would not result in any unacceptable impacts,” he said.
Judge Jones said he found there was a need for trading hours up to 2am on Friday, Saturday and occasionally Thursday nights.

He said the need for late opening hours would drop away between Sunday and Wednesday.
The tavern will be built as part of stage two of the development, which has already seen a petrol station and three takeaway food stores with drive-throughs built.
Final plans include the tavern, a gym and shops.
Judge Jones left his decision open if any of the parties wanted to comment.
