The murder trial of Tasmanian Kyam Keith Broadby is set to begin next week after he allegedly bashed a show worker to death at Mareeba.

Mr Broadby has been charged with one count of murder. He has pleaded not guilty

At a mention in Cairns Supreme Court on Friday, Crown prosecutor Nathan Crane said the trial beginning on Tuesday, October 25 would last five to seven days.

Mr Broadby was represented by Osborne Butler lawyer Sharon Giardina.

“Broadly speaking and as briefly as I can it involves an assault upon the deceased, the assault itself is circumstantial,” Mr Crane said.

“But for alleged admissions said to be made by Mr Broadby to another person who was his partner at the time removed from the offending at the Mareeba Show,” Mr Crane said.

“One of the primary issues in respect of the crown is liability, there was more than one man who was seen chasing the deceased, prior to him sustaining the issues that caused his death.”

Another man was charged with murder but charges were discontinued in October 2020.

Mr Crane said a bulk of the witnesses would be carnival workers, independent travellers who were attending the Mareeba Show or were in their campervans, a pathologist, radiologist and neuropathologist.

“There’s the confessional statement, there's some other evidence after the fact he thought to distance himself by shaving his head and leaving the scene,” he said.

Ayr resident Nathaniel Wailu, 35, was found unconscious at Kerribee Park in Mareeba in July 2019. He was taken to Townsville Hospital with head injuries and later died.
