Widow of Rebels boss Nick Martin sues WA government over husband’s murder

The widow of Rebels boss Nick Martin is suing the WA government over her husband’s assassination at a motor raceway.

The widow and daughter of a bikie boss who was murdered at a motor complex are suing the state government for the mental harm caused by witnessing the assassination.

Rebels boss Nick Martin was shot dead by a sniper while sitting with his family at the Kwinana Motorplex, in Perth’s south, on December 12, 2020.

The hit man was a former soldier, who was charged with murder about three months later and eventually sentenced to 20 years in prison. His name remains suppressed.

Mr Martin’s widow Amanda Martin and his daughter Stacey Smiles are now taking the WA government to court, claiming they were mentally harmed from witnessing the murder.

Premier Roger Cook said he was “perplexed” about the potential legal action and was waiting to be briefed over the statement of claims.

“I am keen to get to the bottom of the matter, to really just understand what their claims are,” he said.

Also named in the writ is VenuesWest, Only Food Sauces and the shooter.

The claim against the four defendants is for negligence and breach of duty under the Fatal Accidents Act 1959.

Ms Martin and Ms Smiles have sued for the mental harm they have suffered from witnessing the murder.

The state government and VenuesWest have been named as defendants in the claim because they were the proprietors and primary interest holders of the motor complex.

Only Food Sauces was named because it was the licensee of a licensed premises under a special facility licence.
