Andrew Cobby trial: Son Luke says mum Kym ‘thinking about leaving’ before death

The son of slain Gold Coast woman Kym Cobby has told his father’s murder trial she told her kids she wanted a “new life” in the weeks before her death.

The murder trial of a man accused of killing his estranged wife has heard the slain woman had confided in family in the weeks before her death her desire for a “new life” by severing contact with her alleged killer.

Prosecutors allege Kym Cobby was murdered by her estranged husband Andrew, 59, on the evening of November 12, 2017 at her Gold Coast hinterland home.

The Cobbys’ son Luke, who was present at the home when his mum was killed and was allegedly second on scene to witness her lifeless body a short distance away from the residence, gave evidence on the third day of his father’s trial.

Questioned about the relationship between his parents in the weeks and months leading up to Mrs Cobby’s death, he told the court, “Nothing seemed out of whack”.

“When they’d say goodbye to each other, they’d lean in for a kiss on the cheek, same as they always had,” Luke Cobby told the court.

However, about four weeks before her death, Mrs Cobby did offer some insight into her mental state, Luke Cobby said.

“She said she was finally thinking of leaving Andrew and wanted to start a new life, but she wasn’t sure,” he told the court.

“She was tired of all the stuff that was going on, it was time to be happy and find a new life.”

He said that the last time he saw his mum alive was when she passed him by in the living room while he was playing video games.

“I said, ‘What are you doing?’” Luke Cobby told the court.

“She said she was just going to take the bin out and (she’ll) be back in a minute.

“She was dressed in her pyjamas ready for bed.”

A short time later, Luke Cobby said he heard a mobile phone belonging to his grandmother, who lived with the family, ringing “again and again”.

It was his uncle, Mr Cobby’s brother-in-law Craig Robert Eden, asking him to check if his mother was home, Luke Cobby told the court.

“I could see mum wasn’t in bed,” he said.

“So I ran down the roadway.”

There, he witnessed his mother’s lifeless body, the court heard.

Luke Cobby also revealed the family home had been visited in the months before his mum’s death by an associate of Mr Cobby who was chasing an alleged debt owed to him.

He said this money dispute occasionally became violent, such as when Mr Cobby received a black eye from the associate who arrived at the family home.

Another to give evidence was paramedic David John Morgan, who assessed Mr Cobby at the scene.

Mr Morgan told the court he discovered Mr Cobby “supine on the gravel driveway”.

He said Mr Cobby suffered “minor abrasions” to both his hands and also his right hip, which Mr Cobby was complaining of pain to.

“He mentioned he had been allegedly assaulted and struck in the head,” Mr Morgan told the court.

The trial has previously heard allegations from Mr Cobby that his estranged wife was ambushed in the dark by an unknown assailant.

Mr Cobby has pleaded not guilty to murder.

The trial continues.
