Lawyers fight for urgent bail hearing for murder-accused Gold Coast Cr Ryan Bayldon-Lumsden

A Gold Coast city Councillor accused of murdering his stepdad has had his bail hearing brought forward after he was transferred to a notorious jail.

A Gold Coast city Councillor accused of murdering his stepdad has had his bail hearing brought forward after he was transferred to a notorious jail.

Lawyers for Ryan Bayldon-Lumsden began fighting for an urgent bail hearing after he was moved from the police watch-house to jail.

Bayldon-Lumsden, 30, was charged with murdering his mum’s long-time partner Robert Lumsden, 58, at their Arundel home last Wednesday after an altercation over a $25 bakery lunch.

Police alleged in court documents that Cr Bayldon-Lumsden, whose division takes in areas including Surfers Paradise, was in an “abusive, coercive and controlling” relationship with his stepfather.

Documents allege Mr Lumsden controlled his stepson’s finances and even his employment with the Gold Coast City Council.

The councillor allegedly told cops that he arrived home about noon on Wednesday after going to a local bakery to buy lunch for him and Mr Lumsden, according to the documents.

Cr Bayldon-Lumsden said he was given $25 to spend and told by his stepfather not to spend any more, the documents allege.

He told police he was “belittled” by Mr Lumsden in the living room for about two hours before getting up to leave, but was followed into the kitchen.

Cr Bayldon-Lumsden alleged he was pushed by his stepfather and then pushed him back, resulting in Mr Lumsden falling over.

The councillor told police he also fell over during the struggle before placing Mr Lumsden in a choke hold, rendering him unconscious.

Cr Bayldon-Lumsden then tried to perform CPR on his stepfather and rang police, but Mr Lumsden died at the scene.

His lawyers have said he intends to plead not guilty to the murder charge.

The councillor has been held in the Southport watch-house since his arrest but was moved to Brisbane’s Arthur Gorrie jail on Tuesday.

His lawyers asked Brisbane Supreme Court for an urgent bail hearing.

Mr Murakami said the court was “run off its feet” dealing with up to almost 10 domestic violence-related bail applications a day and other urgent bail applications were being delayed.

But on Tuesday afternoon Bayldon-Lumsden’s bail hearing, which was originally listed for September 8, was brought forward to this Thursday after representations to the court by his lawyers.

Leading criminal silk Craig Eberhardt KC has been retained in a bid to secure the councillor’s freedom.

Cr Bayldon-Lumsden’s lawyers have also asked Corrective Services to place him in protective custody.
