Adcon Contracting facing wind-up action in Federal Court over alleged unpaid taxes

A company formerly connected to a controversial development figure is facing possible liquidation over an alleged $2.4m tax debt.

A company previously connected to a controversial development figure is facing wind-up action over a $2.4m tax debt.

Federal Court records show The Deputy Commissioner of Taxation has launched action seeking to place Adcon Contracting into liquidation.

Three companies – formwork group Peri Australia, AWE Australia consultants and land surveyors No Problems Just Solutions – have lodged their interests in the matter with the court.

A Federal Court application by the tax office said it served Adcon a statutory demand for $2.43m on May 26 this year and that it had failed to pay.

Adcon was yet to lodge a response to the application, which was due to be heard in court on Tuesday morning.

Adcon Contracting is directed by Maha Bitar, 59, whose registered address is a unit in Bankstown, NSW.

Adcon Group boss Danny Isaac was previous sole director of Adcon Contracting, and shares in the company were held by two of his other companies, until Ms Bitar was appointed in August 2021.

Mr Isaac formed a new company called Adcon Contracting Group that same month.

While he is no longer a registered director of Adcon Contracting, Mr Isaac provided an affidavit on its behalf in a separate court matter in March this year.

In that matter, which has since been settled, Adcon Contracting had applied in the Supreme Court of Brisbane to set aside a statutory demand from Awe Consulting Group.

The wind-up application comes as three Adcon Group companies – that are currently directed by Mr Isaac – are in the Supreme Court of Brisbane battling separate demands over unpaid tax and superannuation.

In that case, Mr Isaac said he didn’t know whether tax and superannuation lodgements had been made for his companies Adcon Engineering, Adcon Structural Steel Group and Adcon Admin because his accountant was diagnosed with cancer.

Another matter is also under way in the Federal Court, where Mr Isaac, who has also been known as Sami Adib, is being sued by the tax office for $3.2m it says are owed to the Commonwealth by him and six companies he directed – including Descon Qld.

Brisbane-based Adcon Qld cancelled its $140m revenue open building licence in March, a month after the QBCC banned it from working in the open category for not having a suitable nominee.
