Celebrity manager Titus Day has abandoned plans to apply for an AVO against singer Guy Sebastian after being charged by police over allegedly defrauding his former client for years.

Celebrity manager Titus Day has abandoned plans to apply for an AVO against Guy Sebastian after being charged by police over allegedly defrauding his former client for years.

Police allege Mr Day, 46, of Bondi, ripped off Mr Sebastian to the tune of $1 million between 2013 and earlier this year when managing the income source of The Voice judge’s career.

In May, Mr Day said he had filed an application in court for a provisional apprehended violence order against Mr Sebastian before he was arrested by police and charged with 61 fraud offences a few days later.

Lawyer Daniel Wakim, appearing on behalf of Mr Day, told Waverley Local Court on Thursday his client had decided to withdraw the application for the AVO.

“We would like to emphasise that the withdrawal was based on mutual and consented agreement between the parties with all parties bearing their own legal costs,” Mr Wakim told The Daily Telegraph outside court.

Magistrate Ross Hudson dismissed the application.

“I’ll mark the application as formally withdrawn and dismissed (with) no issues as to costs,” he said.

Mr Day will return to Downing Centre Local Court on September 17 to face the fraud charges.

According to a police fact sheet previously tendered to the NSW Supreme Court, Mr Day was “calculating” in deciding which amounts of cash to divert and which amounts to pay Mr Sebastian during his alleged offending.

“This shows a large amount of planning and deceit on (Mr Day’s) behalf,” police allege in the documents.

“The amount totals over $1 million dollars — this is a significant amount of money and police believe this is of the higher-level fraud offence.”

The documents say Mr Day started as the director of 6 Degrees management in 2012 and Mr Sebastian was one of the first big stars to leave his old management and “go” with Mr Day in a marquee signing.

After signing this deal, Mr Day effectively managed the income source of Mr Sebastian’s career and the star trusted him, police allege.

The police fact sheet alleges an overseas company called Premier Muzik made 24 payments into a “trust account” for the services of Mr Sebastian between 2015 and this year, but only five of these payments were paid through to the singer.

The other 19 payments were either kept in the account or diverted into unknown accounts, the fact sheet alleges.
