Convicted cop Roger Rogerson’s final bid for freedom will see a secret witness front hearings in NSW’s most powerful court next week.
The infamous detective and fellow former cop Glen McNamara are fighting to overturn their convictions for murdering drug dealer Jamie Gao in a Sydney storage unit.
The pair were given life behind bars in 2016 after CCTV captured them walking into the storage unit with 21-year-old Gao.
Gao had taken 3kg of meth to sell but Rogerson and McNamara took a gun instead of cash. The pair were seen on cameras leaving the rip-off deal, while Gao was found floating dead in the waters of Cronulla a few days later.
The Court of Criminal Appeal, on Thursday, set down the appeal for four days of hearings beginning on Monday.
Fresh evidence is expected to be heard from one witness but lawyers working on the case are seeking to have their identity suppressed.
Crown prosecutors, the court heard, will also push for numerous non-publication orders at the start of the hearing on Monday.
The court was told part of the hearings would examine when a “joint criminal enterprise” was formed in the case.
Previous hearings revealed Rogerson’s appeal will rely on evidence that was considered inadmissable by the original trial judge while the Crown will bring three fresh witnesses to give evidence.
The hearings will run until September 24.
