Sydney cop ‘procured’ schoolgirl before alleged attempted rape

A southwest Sydney cop “procured” a teenage girl for sex at a train station while on duty before he and a colleague allegedly tried to rape her, police allege.

The two senior constables in the Bankstown Police Transport Command – Concord West 29-year-old James Delinicolis and 30-year-old Moorebank father of two Angello Dellosa – allegedly filmed sex with the 17-year-old schoolgirl in Cabramatta in March, according to court documents.

Police allege Delinicolis engaged the girl at a train station “for the purpose of procuring a sexual relationship” and a later meeting was arranged.

According to court documents Dellosa allegedly incited Delinicolis to sexually assault the girl at the meeting.

Each of the officers were charged with filming the incident with the intention of playing it back later.

The documents alleged the men “did produce child abuse material by filming 17-year-old … engaging in sexual activity, with intention that the material would be accessed by (the men)”.

Detectives from the NSW Police Professional Standards Command began a secretive investigation, titled Strike Force Bensbach, into the pair after an anonymous tip.

On Wednesday morning they swooped before dawn, arresting Delinicolis at his Concord West home at 4.55am, charging him with attempted aggravated sexual assault in company, possess child abuse material and misconduct in public office.

Dellosa was arrested 30 minutes later at the Moorebank home he shares with his partner and two children. He was charged with aggravated sexual assault in company, attempted aggravated sexual assault in company and possessing child abuse material.

The attack is alleged to have taken place between 9am and 1pm on a Friday, March 13.

The documents state both men allegedly knew the girl “was not consenting in circumstances of aggravation”.

Police said they “seized several items” during the raids on the men’s homes and were continuing their investigation which now also involves the Department of Education.

The men were refused bail by Magistrate Joy Boulos at Sutherland Local Court on Wednesday and will remain behind bars on remand until their next appearance at Central Local Court on September 15.

They have each been suspended without pay.

The NSW Police watchdog, The Law Enforcement Conduct Commission, has also been briefed on the investigation.
