Melissa Caddick: Missing millionaire’s finances shown in court documents

New details of missing Dover Heights businesswoman Melissa Caddick’s financial position have been revealed in court documents.

Missing businesswoman Melissa Caddick lived in a $7 million home but had just $7000 in her personal bank account — and now her family is seeking access to other frozen funds to pay for mortgages, mobile phones and dietary supplements.

The Daily Telegraph can reveal new details of Ms Caddick’s financial position from an affidavit filed by her lawyer in response to Federal Court action brought by the corporate regulator.

Three days before she went missing from her Dover Heights home on November 13, the Australian Securities and Investments Commission (ASIC) successfully applied to the court for an order to get “the name, physical address, email address and phone number of each person who currently has funds deposited” with her or her company Maliver Pty Ltd, as well as the amounts.

Ms Caddick was told to provide the same regarding her debts.

Maliver was ordered to give ASIC its latest annual financial statement.

The court said this information had to be provided by November 16.

Ten days after the due date, her lawyer, Jennifer Williamson of Brisbane, filed an affidavit saying it hadn’t been possible to comply because her client was “missing”.

In the affidavit, Ms Williamson also said that since November 25 “the homicide arm of the NSW Police has been investigating the possibility that her disappearance is due to her homicide.”

The next day, Ms Caddick’s barrister Jane Muir told the court the police were engaged in a “murder investigation” — a claim subsequently denied by NSW Police.

There is no suggestion that any family member hurt her.

The affidavit explained that Ms Caddick had granted a power of attorney to her brother Adam Grimley in September and that he was providing her instructions.

In detailing why the court’s order could not be complied “within a short time frame”, Ms Williamson said “Mr Grimley’s time is currently being taken up with dealing with police and his family regarding Ms Caddick’s disappearance, and in any event ASIC currently holds Ms Caddick’s and Maliver Pty Ltd’s documents” following a “raid” of the Dover Heights house on November 11.

The Australian Federal Police seized documents, electronic records including security camera footage and personal possessions such as unspecified jewellery.

She estimated it would take “at least another three weeks” to comply with the court order.

“An extension is also desirable to give the parties time to discuss, and hopefully agree on, arrangements for the unfreezing of bank accounts, or at least the release of more funds for the purposes of providing for: living expenses of (Ms Caddick’s husband) Mr (Anthony) Koletti ... the upkeep and outgoings of the Wallangra Road (Dover Heights) property (and) the release of funds for the payment of a mortgage on an Edgecliff property in which Ms Caddick’s parents live”.

Ms Williamson said Mr Grimley needed access to bank records to estimate Mr Koletti’s living expenses and the ongoing costs of her home. The main payments from the frozen accounts included mortgages, phone and water accounts, insurance premiums and Isagenix dietary supplement bills.

“I am informed by Mr Grimley and believe that Ms Caddick’s personal accounts contain limited funds (of) $7202.13 with a debit in one account $1225.42.”

An application on Ms Caddick’s behalf to vary the court’s November 10 will be heard on Tuesday.
