A western Sydney truck driver has been refused bail by a court amid allegations he raped a casual lover in a degrading sexual attack caught on camera.

Police allege Lovejinder Singh Bal, 23, ordered the man to perform a series of humiliating tasks, including doing push ups while naked, and subjected him to vile homophobic slurs before digitally raping him during a nighttime encounter in a housing estate near Blacktown.

According to documents tendered to the NSW Supreme Court, Bal then allegedly threatened to post videos of the abuse online if the man went to police.

The court heard Bal and the man developed a casual sexual relationship after meeting through Snapchat in early 2024.

The man agreed to meet Bal and a friend at the undeveloped Melonba estate one evening in June, where the man unsuccessfully attempted to perform oral sex on Bal, who was too drunk to properly participate.

Police allege the pair began arguing before Bal allegedly started choking the man and punching him in the face while calling him a “dick sucking fa—t”.

It is alleged Bal stripped the man of his pants and underwear and instructed his friend to begin filming them.

The court heard Bal allegedly performed a degrading act on the man then digitally penetrated him while the camera was recording, ignoring his pleas to stop.

Police will allege Bal choked the man a second time while the friend kept filming and threatened to release the videos publicly if the man reported the matter to police.

The court heard the man begged to leave however it is alleged Bal ordered him to strip naked and do push-ups and sit-ups on video.

Police allege Bal and his friend eventually left the location and the alleged victim contacted emergency services.

He was taken to Blacktown Hospital for assessment and provided a recorded interview to police outlining the alleged ordeal.

The court heard Bal’s DNA was found in multiple spots inside the man’s vehicle.

Bal was arrested a day later at his home in Mt Druitt and charged with aggravated sexual intercourse without consent, which carries a maximum sentence of life imprisonment upon conviction.

He was remanded in custody at the time but recently sought bail in a hearing before the NSW Supreme Court, with defence lawyer Elie Srour, of Criminal Law Group, arguing there was no forensic evidence linking his client to any sexual assault on the complainant, nor had any videos of the alleged abuse been recovered by police.

He said detectives were yet to serve their brief of evidence in the matter and any trial would likely be delayed until the end of 2025.

Mr Srour said Bal would agree to abide by strict conditions if released on bail, with his brother-in-law able to lodge a $20,000 surety to ensure he fronted court in the future.

Prosecutors opposed Bal’s release, arguing he had limited community ties and was a risk of flight.

Justice Michael Walton refused Bal’s application, finding he had not proven his ongoing detention was unjustified.

The case will return to Penrith Local Court later this month.
