Disturbing video footage has been released showing a NSW Police officer kicking an Indigenous boy in the face and spitting on him while the teen was under arrest in Western Sydney.

Senior Constable Christopher Borg, 42, was carrying out surveillance in plain clothes when he and his offsiders arrested the 16-year-old in connection to a stolen Audi in the city’s west on September 13 last year.

Newly released video footage of the night-time incident shows the boy sitting while handcuffed on a kerbside before Borg walks towards him and kicks him in the face, causing the youth to fall backwards.

Borg, wearing shorts and with his hands in his pockets, then walks away before returning to stand near the boy. A second man was watching on during the incident.

The video footage also shows Borg later spitting on the boy.

The footage was released to The Daily Telegraph by the NSW Office of the Director of Public Prosecutions on Thursday.

A police fact sheet stated the boy had been compliant with police before the attack.

Borg pleaded guilty to two counts of common assault over the incident, and failed in trying to have his charges dismissed for mental health reasons.

NSW Local Court Magistrate Susan Horan said the boy was in a vulnerable position and the attack was unprovoked.

She said the court must send a message to stop police from being violent.

“There is a significant and overwhelming public interest in these matters … and in preventing, deterring, and punishing police violence,” she said.

Borg was sentenced to a 10-month intensive correction order, which is effectively a prison sentence that is served in the community.

Court records show Borg has lodged an appeal against his sentence in the higher NSW District Court.

He is next listed to face Downing Centre District Court for a hearing on July 15.

Borg was a police officer for 11 years and he is no longer employed by NSW Police.

His defence lawyer, Warwick Anderson, said his client’s conduct was serious, but that Borg had suffered from depression and anxiety.

“(He) slowly descended into the grips of this mental health problem, which resulted in him offending in the way that he did,” Mr Anderson said in court.

Prosecutor William Logan told the court the boy was unable to defend himself because he was handcuffed with his hands behind his back.

“In recent decades there has been enormous public interest, both domestically and globally, in preventing and deterring and punishing police brutality,” he said.

“There were a number of duties of care Mr Borg owed to (the boy) … each of those duties was breached intentionally.

“These acts were not force in connection with a lawful police duty.

“This was simply an unlawful assault on two occasions against a 16-year-old boy in custody.”
