Mahmoud ‘Brownie’ Ahmed murder: Charges against Frank Delcol dropped

Charges have been dropped against a man police alleged was an accessory to the murder of underworld boss Mahmoud “Brownie” Ahmad.

Charges have been dropped against a man police alleged was an accessory to the murder of underworld boss Mahmoud “Brownie” Ahmad.

Frank Delcol was last June the first man to be charged in relation to the slaying of Ahmad, when detectives from NSW Police Taskforce Erebus raided his home at Wetherill Park and found a backpack filled with cloned plates.

Police alleged that Delcol had dropped off the getaway car used in the murder at an agreed location on April 25, before picking it up again on May 3 — at which point they allege he swapped the number plates on the car for another set of cloned plates.

But Confidential can reveal that Delcol’s charges have now been dropped.

One count each of accessory after and before the fact to murder were all withdrawn at Parramatta Local Court in early December.

In a bail application in June before the charges were dropped, Delcol’s barrister Greg James QC said there was nothing in the allegations by police to suggest he knew the car was to be used in the execution of Ahmad.

“There is nothing to suggest he had any knowledge, before or after the murder, at the time he had any link to the vehicle or was involved in the movements, or the commission of the murder,” Mr James said.

“We’re left with a hypothesis at best that because he had something to do with the car, he must have had something to do with the murder.

“It’s stretched at one point to say that he had something to do with the planning.”

Delcol remains behind bars on remand awaiting trial on charges of taking part in supplying a large commercial quantity of drugs, dealing with proceeds of crime and participating in a criminal group.

During the raid on his home in June, police allegedly found more than $22 million worth of ice and $200,000 cash in a lockbox.

He is next due back in Parramatta Local Court on February 2.
