The trial of a Sydney solicitor, charged with destroying evidence in a murder probe, has taken an eleventh-hour twist with police claiming they have recovered lost footage of her husband stuffing a gun down his pants.
Alev Oncu, a criminal defence lawyer from Sydney, was charged by police four months after Craig Anderson, 51, was shot dead at Doonside in the city’s west.
Her husband, Ali Cevik, is among a group of men charged with Mr Anderson’s murder and will face trial next year after pleading not guilty.
Oncu has pleaded not guilty to one count of tampering with evidence and another count of perverting the course of justice after police claimed she had destroyed potentially crucial evidence in the murder investigation.
The case was set down for trial, on Monday, but Parramatta District Court heard police had uncovered CCTV footage, previously thought to be deleted, late last week.
The discovery was only made when a NSW Police database was updated, the court heard on Monday.
“As a result of that update the previously thought deleted CCTV footage has been recovered,” the Crown prosecutor told the court.
“On the Crown case has, at its highest, the husband of (Oncu) placing a firearm down his trousers before leaving the premises.”
The court heard the footage was discovered after the case went before the highly secretive NSW Crime Commission but its significance is not yet known.
The commission has previously made orders to keep tabs on two properties, a BMW coupe and bank accounts registered in Oncu’s name as part of the probe.
Oncu’s defence solicitor told the court they would be enlisting an expert to examine the footage.
Police allege Mr Anderson was shot four times by Jim Dastan, 27, outside his home in May 2019.
Dastan is facing one count of murder while his younger brother, Joshkun, and Cevik both face charges of murder and participating in a criminal group.
They will face trial in the Supreme Court next year.
Oncu’s trial was stood over until Wednesday.
