Kurt Toole dealt drugs while cops watched, court docs reveal

NSW Police Minister Paul Toole’s brother Kurt will be sentenced after pleading guilty to charges over dealing cocaine and amphemtamine and a pub brawl.

The brother of NSW Police Minister Paul Toole will be sentenced by a court after his life as a Breaking Bad-style drug dealer and pub brawler led him to a lonely prison cell.

Kurt Toole, the MP’s younger brother, pleaded guilty to dealing amphetamine and cocaine after he was arrested in mid-2021.

There is no suggestion Paul Toole engaged in any wrong doing.

The politician’s little brother, Kurt had been snared by a NSW Police strike force set up to uproot drug networks operating in their hometown of Bathurst, court documents reveal.

Police documents, released by the NSW District Court, reveal the nascent Strikeforce Resche was watching a suspected drug dealer in mid-2020.

Listening devices captured when the accused dealer and his girlfriend spoke about gathering $1820 for Kurt and met him at their home, the document says.

The court documents state the accused dealer and Kurt met at Paddy’s Hotel later that afternoon where Kurt handed the accused dealer six grams of cocaine.

On another day in June 2020, the documents say, police listened in as Kurt got into the accused dealer’s car and handed him 224g of amphetamine.

It was “old school gas”, Kurt told the accused dealer.

“If they don’t like that, I don’t know what they’ll like.”

Kurt handed over another plastic bag with a further six grams of cocaine in it, the police document says.

The men continued to talk about the drugs with Kurt telling the accused dealer “it looks alright” and he had some similar product years earlier.

“F***ing oath it does,” the accused dealer replied, according to the court document.

The alleged dealer later told another friend he purchased the drugs off Kurt and “shooters” loved the drug while “smokers” said it was like smoking diesel.

The alleged dealer, according to the document, had told his girlfriend he paid over $16,000 for the amphetamines and would make $12,000 profit by onselling the drugs.

The court documents also says the alleged dealer met with Kurt on a soccer field to buy a further 10 grams of cocaine before sitting in the car and recording the bag while bragging about the “mad night” ahead.

About two months later, Kurt Toole was drinking with his brother, Joshua Toole, and others at the Oxford Hotel in Bathurst on 20 August 2020 when a brawl broke out, the court documents state.

Kurt was captured on CCTV collaring one man in the melee, throwing elbows and fists and slapping another man in the mouth.

The brawl spilled onto the street but Kurt left once police arrived.

The accused dealer is facing dozens of drug supply charges but has yet to enter a plea.

It would take almost another year to arrest and charge Kurt, and he initially denied dealing drugs.

Since then he has pleaded guilty to two counts of supplying an indictable quantity of drugs and two more drug charges wrapped together. He also pleaded guilty to affray for the pub brawl.

His time so far in prison has been difficult, the court heard; he has spent the last four months in segregation.

He is working as a sweeper in Bathurst prison, the court heard, and sometimes is allowed to help feed other inmates by passing food through a slot in their heavy metal doors.

But the Crown Prosecutor, on Monday, asked for the case to be adjourned so they could continue to read documents in the case.

Mr Toole’s barrister was frustrated at delays in the case.

“I have, with respect, the sense that Madame Crown is basically fishing,” he told the court.

“She‘s wading through this material not knowing what she’s seeking to achieve.”

It had been almost two years since Kurt was arrested and almost three since he committed the crimes, the court heard.

His father sat in court on Monday where the judge said Kurt will be sentenced on Friday.

Joshua Toole, late last year, was arrested and charged over a separate and unrelated drug dealing allegation - he has yet to enter a plea.

The court heard Joshua Toole was on parole for previous drug supply offences when he was captured by telephone intercepts allegedly using the encrypted app Threema to direct a criminal group and supply drugs using the handle “Smiley”.

He was released on bail because, like Kurt, he was being kept in segregation.

The NSW Supreme Court heard Joshua was kept in his cell for more than 23 hours a day because his brother was the police Minister and deputy premier.

The judge called it “unacceptable” and ordered his bail.
