Kavines Sivabalan faces court on rape, choking charges; granted bail despite police opposition
A Sydney man accused of raping, stalking and choking a 21-year-old woman he met on Instagram has been granted bail despite police opposing his release.

An Instagram friendship turned into a nightmare for a 21-year-old woman after she was allegedly raped three times over two days by a 20-year-old man from Blacktown.
Kavines Sivabalan allegedly met up with the woman in July at a rural Morisset property in Lake Macquarie after they made contact on Instagram in July this year.
But the catch-up allegedly turned into a frightening ordeal for the woman, with police claiming that Sivabalan raped her while armed with a knife and had sex without her consent on another three occasions.
He also allegedly choked her, stalked her and threatened to hurt her.
Sivabalan was granted bail on Boxing Day in Parramatta Local Court despite police opposing his release.
It is alleged Sivabalan and the woman had started communicating on Instagram – the accused has since deleted his account.
The woman organised to collect Sivabalan from Morisset Railway station on the afternoon of July 6 before the pair went to a nearby address.
Over the next two days, police allege Sivabalan sexually assaulted the woman multiple times and threatened her with a knife.
After the alleged 48-hour ordeal, she went to police and reported the allegations.
“In July 2022, detectives from Lake Macquarie Police District commenced an investigation following reports a 21-year-old woman had been sexually assaulted by a man she’d met online,‘’ police said in a statement.
“Following extensive inquiries, a 20-year-old man was arrested at Parramatta on December, 26.
“The Blacktown man was charged with intentionally choke person without consent, aggravated sexual assault – inflict actual bodily harm on victim, three counts of sexual intercourse without consent, two counts of stalk/intimidate … and armed with intent to commit indictable offence.”
Court documents allege he had sexual intercourse without the victim’s consent three times between 4.30pm and 8.40am July 6 and July 8 this year. They also claim he choked her.
It’s also alleged he had sexual intercourse while he was armed with a knife.
No plea was entered on Boxing Day and Sivabalan was bailed to appear at Newcastle Court on March 8 for a committal hearing. His bail conditions include reporting to St Mary’s police every day, not going into the suburb of Morriset, not going near or contact by any means a person whose name is suppressed or any other prosecution witness.
Sivabalan also is only allowed to possess one mobile phone and inform police of the number within a day of his release.
The accused was also charged on an unrelated matter of stealing a mobile phone on Boxing Day at Parramatta, to which he pleaded guilty.
