Judge Roy Ellis was emphatic when he told ice seller Kade Jason Fredericks that he could escape a jail term for his drug dealing deeds as long as he completed a full-time rehabilitation program.
But even Fredericks saw the writing on the wall, warning authorities that he was at risk of relapsing after running into some old friends from jail at the City Sleep Safe rehab program in Newcastle last year.
Within two months of being told in Newcastle District Court that he was in the clear if he finished the program, Fredericks was caught selling drugs after “relapsing”.
The relatively-minor fresh dealing charge was dealt with in the lower court, but it meant Fredericks had to face Judge Ellis again on two counts of ongoing drug supply, an offence which carries a maximum jail term of 20 years in jail.
Fredericks, of Fern Bay, had already admitted to running a busy drug operation across parts of the Hunter between June and August last year.
The first charge was that he had supplied a total of more than 24 grams of methamphetamine during 27 occasions in June and a further total of 13.5 grams on a dozen occasions, as well as gamma butyrolactone, in July.
Judge Eillis sentenced Fredericks to a maximum jail term of three years with a non-parole period of one-and-a-half years.
Backdated, it will see Fredericks eligible for parole in July this year.
But even after sentence, Judge Ellis again spoke to Fredericks about his future, urging him to try rehab again once he is released.
“You are now 31 years of age. If you don’t want to be still there when you are 51 years of age, you need to deal with it,’’ Judge Ellis told Fredericks.
He later added: “Good luck to you”.
